Do you need to have to pay a tax stamp for a  m16 auto sears or is it just a part at that point?

The original M16 automatic sear (GI auto sear) is just a part.
(Technically, it's an assembly. )

The reason it's uncontrolled is that if your receiver can accept it, then the receiver is the MG.

All the other "sears" (of which I'm aware of 4 styles) for converting semi-auto AR-15 to full auto are MG conversion devices, which means they are MGs all by themselves (even with no host firearm around). That's because they "drop-in" to an unmodified receiver/firearm.

They are potentially very expensive. Unless you have a Class III manufacturer's license, any receiver modified to accept these parts without a tax stamp already approved will cost you 10 years in prison and a $10,000 fine.

That doesn't include the fallout of that federal felony history following you forever and a lifetime ban on owning any firearm or ammunition ever again. Did I mention that ALL of your currently owned firearms will be conficated upon your arrest.

A $30,000. legal machine gun seems like a deal in comparison.

A manufacturer's SOT is Class II.

(Class III is dealer, and Class I is importer.)
These are all the result of holding the corresponding FFL (Federal Firearms License), then paying the annual SOT (Special Occupational Tax).

Borderpatrol listed the maximum sentencing.
Typical sentencing is 2 years and no fine (with probation offered to first offenders).

The federal felony conviction is a long-lasting problem however.
It requires a presidential pardon to (sort of) go away, and you'll forever have problems obtaining employment.

*If* a convicted felon can obtain a presidential pardon (which is difficult), one may have their rights restored following successful completion of a petition process (but that's only possible after the sentence is satisfied).

It isn't normal for all the offender's firearms to be seized. It does happen sometimes, but usually it's only the ones connected to the offense. If they're all seized irrelevant to the offense, it's generally because the offender foolishly signed a forfeiture and waiver form.

The remaining firearms (which aren't contraband or evidence) will still be owned by the person, even if they cannot lawfully possess them. It's very likely they'll have to be sold though.
Arrests like this usually lead to horrible financial problems, divorces, that kind of stuff.

It's pretty good if you don't count ITAR fees.

Being a government entity is the best deal.
Everything's tax-exempt.
