They need to get the guy that the illegal was selling the guns to also.

Why the hell would they title the article with "Kansas Man..."

He's not a Kansas man any more than I am.  He's from Guatemala and he's here illegally.  Headline should have been, "Illegal Alien..."

Where in the article did it say that the table holder wasn't a dealer?  In theory he could have gotten the guns from a dirty FFL - though doing that sort of transfer at a gun show is beyond stupid.

We are seeing more and more illegal Guats here at the northern border as well. I ER'd one last night....He'll be removed from the US after he serves his time and smacked with a lifetime bar. Next encounter with him and he'll right to jail.

OP- it is not the gunshows fault anymore than it is the newspapers fault for running private ads.

Are you advocating  ending private sales, or just ending private sales at gunshows?

lifetime bar doesn't count for someone who doesn't mind being here illegally.  then he just gets more free room and board on our dime.

Yeah.

The guy should be fined, all property of his in country should be seized and he should just be deported back to his country. Fuck paying for his room and board for nearly half a decade.

Whitworth, United States Attorney for the Western District of Missouri, announced that a Guatamalan national pleaded guilty in federal court today to illegally possessing firearms that he purchased at a local gun show and intended to sell to an intermediary who would deliver them to Mexico.



Mynor Guerra, 25, a citizen of Guatamala who was residing in Overland Park, Kan., pleaded guilty before U.S. District Judge Gary A. Fenner this morning to being an illegal alien in possession of a firearm. Under the terms of today’s plea agreement, the government and the defendant agree to request of the court a sentence of four years and nine months in federal prison without parole.



Guerra admitted that, for the past six months, he had been buying firearms at gun shows and selling them for extra money to an intermediary, who delivered the guns to Mexico.



Guerra was arrested on July 25, 2009, after being observed by ATF agents who were conducting surveillance of a gun show at the Expo Center at Kansas City International Airport in Kansas City, Mo. ATF agents saw Guerra carrying an AR-15 rifle, walking in a circuitous route through a parking lot to his vehicle. He looked over his shoulder several times then placed the weapon in the trunk of a Toyota Camry. Guerra walked back into the show, approached a display table, pulled out a large sum of cash, and proceeded to purchase a second AR-15 rifle without filling out any paperwork. Guerra immediately exited the building and began walking away, again taking a circuitous route to his vehicle. Eventually, he made his way to the Camry and put the rifle in the trunk.



Police officers stopped Guerra’s vehicle a short time after he departed from the gun show. He presented a fraudulent Missouri driver’s license as well as a false Social Security number. After about ten minutes of false stories, Guerra admitted his identity and that he was an illegal alien from Guatemala. He was arrested for being an illegal alien in possession of firearms, specifically two AR-15 style rifles. The rifles were recovered from the trunk along with gun show calendars listing shows in several different states. Also recovered were two clips, one designed to hold 15 rounds of ammunition, and a second designed to hold 30 rounds.



Police officers interviewed Guerra’s girlfriend at their apartment, who told them that Guerra goes to gun shows, and that he buys and sells guns. Six magazines and nine handgun holders and cases were discovered in the residence along with various gun cleaning supplies and firearms manuals. Five gun show calendars were also discovered as well as a Western Union receipt in the amount of $4,000 to and three Social Security cards in another person’s name.



Under federal statutes, Guerra is subject to a sentence of up to 10 years in federal prison without parole, plus a fine up to $250,000. A sentencing hearing will be scheduled after the completion of a presentence investigation by the United States Probation Office.



This case is being prosecuted by Executive Assistant U.S. Attorney Daniel M. Nelson and Assistant U.S. Attorney Philip M. Koppe. It was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Kansas City, Mo., Police Department.

If you have a booth at a gun show, you dam sure better be an FFL IMHO.

It is one thing to buy a gun from a guy walking the show with a gun for sale flag in the rifle he has shouldered, it is another thing entirely to set up a booth worth of guns and NOT be considered a buisness. It is things like this that end up fucking up gunshows for everyone.

So you have a 30 gun private collection, and have suddenly decided to sell tham all at once at one show? Tough luck buddy, sell them thru an FFL, or sell them individually in face to face transactions elsewhere.

Mmm... no. Just like I don't need a sales tax number to have an estate sale.

I almost went to that show.  I assume those ARs were private sales, since it doesn't report hauling in an FFL.

what difference will that make?  the guy had a fake dl and a fake social security number.  besides that, if he's supplying them to organized crime in mexico, what do they care if they have to pay another hundred bucks per rifle so their guy can find a willing stand in for a straw purchase?


I don't have a problem with private sales. I'm just saying these guys who have 50 guns on a table and are not FFL's will eventually lead to private sales being banned at shows.


that's batfe's job, and it should be fairly easy to do.  the promoters keep records of who rented booths, and those can be searched without a warrant if the promoter agrees.  so if joe unlicensed dealer keeps renting a table and claiming that the stack of rifles he sells are part of his personal collection, it should be fairly easy to make a liar out of him.  if he built 50 ars, he still had to get the receivers from somewhere.  that can also be tracked.  imo there are more than enough records to charge such a person if the investigators choose to do so.

what really surprised me was  that missouri  transitioned from magazine fed ar rifles to clip fed models.
