Fatal shooting of ninja-style attacker found to be justifiable

(3-6) 18:35 PST HEALDSBURG -- The fatal shooting of a home intruder in a ninja mask was tentatively found to be justifiable homicide, Healdsburg police said today.

"We don't have any evidence to show otherwise,'' said Sgt. Tony Pinochi, following an investigation into the Feb. 27 shooting of David Ferguson, 48, by Healdsburg resident Louis Phillips.

Ferguson, a former employee of Phillips at an Indian tribe's casino near San Diego, was dressed in black and wearing a ninja-type mask when he assaulted Phillips wife, Sandra, before entering the couple's home, police said. Louis Phillips, 68, shot Ferguson three times with a .357 Magnum revolver.

Ferguson was carrying a BB gun, tape, a blindfold and a knife when he was shot.

Ferguson was the chief financial officer at the Viejas casino east of San Diego in 2000 when Phillips, the chief executive officer, fired him, police said.

That's just weird.  How does a CFO get fired and resort to thuggish crime?  He could have at least stuck to white collar crime.
