I'm watching COPS right now. Long story short, the officer is reviewing mall security footage showing a man attempting to return stolen merchandise. Store security (Skinny dude in jeans, cowboy hat, big buckle...) calmy tells the rather large (!!!) suspect to come with him. Suspect fights back (crazy!).
Officer watcing the video says "I'm glad I didn't have to fight him. That's a big 'ol boy. He's a little too big for me, I'd have to just shoot him".  He also mentioned that in Texas, if a citizen makes a lawful arrest, he has the same rights as any police officer - i.e. if the guy starts fighting...well..."You gotta fight back".

Texas is awesome. Duh.
And yes, if you see someone committ a felony, you can arrest them and if they resist, you CAN kick their ass until they stop resisting. Also, in Texas you CAN shoot someone if you reasonably believe that it's the only way to get your stolen property back. I.E., someone breaks into your car, steals your stereo, and runs off, you can shoot him if you can't catch up and tackle him. |
