The Protection of Lawful Commerce in Arms Act was passed out of the House Judiciary Committee this AM. A number of amendments were proposed to punch loopholes in the bill. Despite the number of amendments being proposed, only one passed and it was of a grammatical nature. The bill is still intact.

The amendments proposed ranged from a domestic violence exclusion to informing dealers that a buyer was on a terrorist watch list thereby providing civil liability. House Bill 1195 is already introduced to criminalize transfers to those on the watch list. So, if the gun grabbers can not get a bill passed to criminalize transfers to people on the terrorist watch, they just wanted to make the sellers responsible. Expect similar attempts before the bill is voted on in the full House.

This should be a snap passing; just a matter of killing any ant-gun amendments from being attached.

The companion bill in the Senate (S 397), already has 57 supporters.

Washington, DC - During consideration of H.R. 800, gun lobby allies on the House Judiciary Committee showed their extremism and lack of concern for public safety by rejecting several amendments.

“The gun lobby allies on the House Judiciary Committee made their extremism crystal clear today -- they gave special legal privileges to even the most reckless gun sellers, like Bull’s Eye Shooter Supply which armed the DC snipers, and stripped away legal rights that protect gun violence victims and promote public safety,” said Michael Barnes, President of the Brady Campaign to Prevent Gun Violence.  

The first amendment, offered by Representative Chris Van Hollen (D-MD-8), would have allowed lawsuits against negligent gun sellers.  The amendment was necessary because the underlying legislation would have severely limited the rights of victims harmed by negligent gun sellers.  It gave Committee Members a clear choice: either allow lawsuits against negligent gun sellers, or let them get away with death and injuries caused by their negligence.  Incredibly, the Committee defeated the amendment by a vote of 8 to 19.  

Representative Linda Sanchez (D-CA-39) offered an even narrower amendment that would have protected the rights of those hurt because a gun seller sold a gun to a domestic violence offender.  But this amendment was also rejected by a vote of 10-21.

The final amendment showed the extent to which some Committee members were willing to do the gun lobby’s bidding, even if it means jeopardizing public safety.  The amendment, offered by Representative Van Hollen, would have allowed lawsuits against gun sellers when they knowingly sell a gun to someone on the federal government’s terrorist and gang watch list.  The Government Accountability Office recently reported that terrorism suspects on that list had been allowed to buy guns, and this amendment would have at least allowed some of those victimized by gun sales to terrorists and gangs to seek justice.  Even this amendment was defeated by a vote of 10-20.  It seemed that protecting gun sellers who knowingly sell guns to terrorists was too much to stomach for one usually reliable gun lobby ally, Representative Dan Lungren (R-CA-3).  When it came his turn, Rep. Lungren dodged the issue by voting to “pass.”  

The Judiciary Committee eventually passed the legislation without the amendments, by a vote of 22-12. Representative Lungren voted for the bill.
