I read about the ban in the morning paper, and the wording of it is scientifically inaccurate and cannot be upheld in court. It claims the stock makes the gun fire 'automatically' without mention of the fact that the trigger finger is what pulls the trigger for each and every shot. We all should already know, but the definition of 'machine gun' since 1934 has been 'more than one shot per each manipulation of the trigger'. With the new ban they have made the previous definition meaningless so now any kind of firearm that can be 'bump-fired' becomes a machine gun, and a real machine gun is now unclassified. Obviously this cannot survive any scrutiny at all so it won't stand up.
Now, if the real goal is to use this kind of semantics to effect a 'back-door' ban on all self-loading firearms, at least it would explain how ATF engineers could come up with this fiction which has nothing to do with how a 'bump-fire' device works. |
