TEMECULA - Perhaps it was the searing summer heat, but cool heads did not prevail Thursday when two men -- one an off-duty Oceanside cop, the other a Rancon real estate agent -- butted heads over a blocked driveway, authorities said.

Just before 11 a.m., a caravan of agents pulled into a Temecula neighborhood at Primavera and Garbiano drives to view a new listing. Rancon President Mike Diaz said there were about 70 agents in the convoy.

According to Temecula police Sgt. Dave Kondrit, the officer's wife, returned home to find her driveway blocked by one of the agent's vehicles.

After she was allowed into her driveway, the woman came out to confront the agents and a verbal argument ensued, Kondrit said.

The woman's husband, the officer, came out of the house, and the shouting continued.

According to some witnesses, the officer head-butted a male agent, Kondrit said. Other witnesses, however, said the two men came at each other and bumped heads.

The agent punched the officer in the face, knocking him to the ground, Kondrit said. When the officer got up, he was punched a second time, Kondrit said.

Fearing that his wife might be in danger, the officer went back into his house and emerged with his holstered service revolver at his side and yelled for his wife to go back into the house, Kondrit said.

The man identified himself as a law enforcement officer, Kondrit said. He did not remove the gun from its holster, he added.

At least four Temecula deputies responded to the scene along with fire, paramedic and ambulance crews. The scene drew dozens of curious neighbors out of their homes.

In the end, neither the officer nor the agent decided to press charges.

"After thinking it over, they let the issue drop," Kondrit said.

"A cool head on either party would've resolved it," he added.

Yet, about an hour after the incident, emotions were still running high. A deputy had to separate a neighbor and another agent when they, too, got into a shouting match.

angry, or threatening manner, or who, in any manner, unlawfully uses
any loaded firearm in any fight or quarrel upon the grounds of any
day care center, as defined in Section 1596.76 of the Health and
Safety Code, or any facility where programs, including day care
programs or recreational programs, are being conducted for persons
under 18 years of age, including programs conducted by a nonprofit
organization, during the hours in which the center or facility is
open for use, shall be punished by imprisonment in the state prison
for 16 months, or two or three years, or by imprisonment in a county
jail for not less than three months, nor more than one year.[red]
  (c) Every person who, in the immediate presence of a peace
officer, draws or exhibits any firearm, whether loaded or unloaded,
in a rude, angry, or threatening manner, and who knows, or reasonably
should know, by the officer's uniformed appearance or other action
of identification by the officer, that he or she is a peace officer
engaged in the performance of his or her duties, and that peace
officer is engaged in the performance of his or her duties, shall be
punished by imprisonment in a county jail for not less than nine
months and not to exceed one year, or in the state prison.[/red]
  (d) Except where a different penalty applies, every person who
violates this section when the other person is in the process of
cleaning up graffiti or vandalism is guilty of a misdemeanor,
punishable by imprisonment in a county jail for not less than three
months nor more than one year.
  (e) As used in this section, "peace officer" means any person
designated as a peace officer pursuant to Chapter 4.5 (commencing
with Section 830) of Title 3 of Part 2.
  (f) As used in this section, "public place" means any of the
following:
  (1) A public place in an incorporated city.
  (2) A public street in an incorporated city.
  (3) A public street in an unincorporated area.
