Some states have mutual combat laws where nobody is charged.  Florida I think.

I have tried about 20 assaults in the past year and a half.  In Texas, any assault causing bodily injury (e.g. pain, physical injury) is a class A misdemeanor, 0-365 jail and/or $0-4000 fine.  Most get probation, some get jail.  Ive put a few away for 200-300 days.

ETA: self defense, reasonable discipline, mutual combat are common defenses.

Depends how zealous the DA is.  Clearly neither party will wish to press charges against the other, but the state may charge one or both on the other's behalf. Without their consent. Because justice.

It made my ex wifes boyfriend fear for his life apparently. Oh well, any dude she brings around my son should have a healthy fear for his life because if anything happens to my son....

He was charged with domestic violence.
I don't remember how it all turned out, but I think it ruined his chance to be a lawyer.

that's been my experience, from the viewpoint of one of the guys in the fight.
no weapons, no serious damage, nobody willing to press charges.

If I rolled up on it or got the call to go to it, Disturbing the Peace by Fighting ticket, and part ways.

That is if you were being a complete ass clown about it, if it was understood that both parties were in agreement and no one wanted to pursue charges, gather statements and leave.

I just watched one of my best friends and a tweaker douche bag throw down on college grounds a few months ago. We all three had to talk to the campus poh-lease. That was all that came of it for us two. Just questioning. The tweaker douche bag was on probation, we went from seeing him every day to never seeing him again. I'm guessing he got phucked because of the probation

In Oklahoma it is considered mutual combat ( as long as no weapons are involved and no major Injury occurred )

No citation or arrest, just have a nice day. If you do it in public you might get disturbing the peace or if drunk thrown in the drunk tank.

Not here, but it depends on the cop. Simple assault / affray, generally community service and unsupervised probation. Seen them get very short suspended sentences with 6 or 12 month supervised probation terms at times, that comes down to the judge.

I have a woman who got two years of supervised probation for throwing a water bottle at her husband... with a suspended sentence of 5 days

But depending on the circumstances it can be a lot or a little.

Never been in one

When I was younger they were pretty common especially in high school. Almost weekly occurrence where a couple of guys duked it out in the restroom while many watched and someone watched the door for teachers. Fun time, fun times.

In Connecticut, there are a variety of charges that could be used depending on the specifics. Those can include Creating a Public Disturbance (an infraction, subcriminal), Disorderly Conduct, Breach of Peace 2d, Assault 3d (or higher degree assault charges in certain instances....).

dude, I saw a guy take several hits across the head with a whiskey bottle once and not get medical treatment. He was seeing double...
if a cop saw that or witnesses would swear to it, that would be an arrest and prosecution.

I had a call for this very same thing last night. Two grown adults who mutually fight each other and no one wants to sign complaints against each other or need medics...... Bye. No charges for either, thanks for the 5 min of entertainment.

But to actually answer your question. If physical contact was made its a battery. If serious bodily harm was done or happened in a public street then it's an aggravated battery. If someone was in fear of being hit but wasn't then it's just an assault.

When I was in high school (early 2000's) it was a mandatory suspension.

Nowadays I believe they call the police and have the 'combatants' escorted out in handcuffs.  This is what my brother said when he worked in a high school computer lab for a couple of years.

In New Mexico they won't arrest you unless they actively catch you in the act of fighting.... Unless your at a bar then they don't have to witness the fight. Not sure what the charge is though. I would guess simple battery (misdemeanor) unless a weapon was used or serious injury occurred. I tend to avoid that kind of stuff though so I could be wrong about the charge.

It all depends on state OP.

In Virginia, unless witnessed in the presence of an officer, only the victim can swear the warrant out for Assault and Battery.

And if in the presence of an officer, if the victim wishes to press charges, a summons(ticket for assault & battery) will be issued.

Misdemeanor/simple assault.

Comes with a 10 year state level prohibition on firearms possession that from what I understand is a motherfucker to get corrected/removed.

Will also have a seriously negative impact on state level professional licensure too.

If spouse/family member/roommate etc, it is domestic violence so bye bye 2a for life.
