This is a 2005 proposed rule. Never implemented. It's being revived...... SUMMARY: The Department of Justice is proposing to amend the regulations relating to machine guns, destructive devices, and certain other firearms regulated under the National Firearms Act (NFA) for the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) to clarify the definition of the term ‘‘pistol’’ and to define more clearly exceptions to the ‘‘pistol’’ definition. The added language is necessary to clarify that certain weapons, including any weapon disguised to look like an item other than a firearm or any gun that fires more than one shot without manual reloading by a single function of the trigger, are not pistols and are classified as ‘‘any other weapon’’ under the NFA. Omitted from the proposed regulation is the language: ‘‘any gun altered or converted to resemble a pistol.’’ This language mirrors the statutory provisions in 26 U.S.C. 5845(a)(2) and (4) that refer to weapons made from a shotgun or rifle. The NFA adequately reflects the Department’s consistent position that a rifle or shotgun, altered to function as a smaller, pistol-like weapon, maintains its classification as a rifle or shotgun and will not be classified as a pistol. Therefore, the addition of this language into the proposed regulation is unnecessary. (Nolo's note: for now. Sounds like they want to shitcan ar and ak pistols.
In states that don't allow sbr, we are fucked again. I would presume no more of the mare's leg type lever guns as well. |

If the AR started out as a pistol, then I would say the rule doesn't apply to it. If you take an existing rifle/carbine AR and turn it into a pistol then I would say it applies.

I see it as going after pistol griped shotguns and lever action mare's legs, since they are not reloaded solely by the trigger. An ar pistol isn't a modified rifle but rather built from the start as a pistol. You can't take a rifle and make it into a pistol legally now.

I'm not sure about the second part, because the definition sounds sort of machinegun like, but the first part about things that don't resemble guns, it to make things like brass knuckle guns into AOW.

Reading it, they seem to be trying to find a way to change the "rifle to pistol to rifle" thing.
IE, they want to make it so you cant build a rifle into a pistol |

He's looking for any outlet to restrict gun rights that he can slip by the courts and Congress. Everything is incremental steps with these guys. You have to look 5 or 6 steps and 10 years down the line to get a feel for what they're doing. Of course they'll lie to your face and say they don't want to force AR and AK pistols under NFA rules, but that's exactly what they're aiming for... pun intended. They are some conniving bastards. |
