Gun registration is illegal per 1986 FOPA

"No such rule or regulation prescribed [by the Attorney General] after the date of the enactment of the Firearms Owners Protection Act may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or disposition be established. Nothing in this section expands or restricts the Secretary's authority to inquire into the disposition of any firearm in the course of a criminal investigation."

Perhaps, since the lawsuit failed in the 2nd Circuit on constitutional grounds (because the judges don't follow the Constitution), another course of action is to sue for the violation of FOPA, which forbids any State from establishing a registration database.

That particular part of the statute applies to the federal govt, not the states.  It basically says that the Federal Government Cannot transfer Firearms transaction records to the states, nor can the federal government maintain a registration system. The comma after the part in bold in the OP is important in comprehending the statue

Keep on dreaming that the feds are not keeping records.. Everytime you call info for a nics check they give them back a code.. they are keeping records.

To my understanding it's that the fed can't make the states do registration.  States are free to do it of their own accord.  So yeah, FOPA doesn't cover state-run firearms registries unless the fed (I.E. the AG) tells them to do it.
