I sold some match ammo to a NYer on gunbroker even though my discription says no shipping to NY. He is trying to talk me into shipping since there is no check in place for ammo yet.    I quote the last sentence " Prior notice will be given to all sellers on a timely basis before the database is completed and before any requirements go into effect."
This so called database has not yet been established, therefore the ammo requirements are not in effect yet.
This tells me that you can send me the ammo directly.   My question is this still illegal?

I think FTF within NY state by individuals not in the business of selling ammo is still like it was pre safe act.

There isn't an operational back-ground check system in place yet.
The State mandated that ammunition sellers/receivers/handlers/dealers/etc. in the State either have a FFL or register to do so.
Ammo sent from out of State is supposed to go to either a FFL or someone registered, but from there (at this time) they have no further requirements (sans the long standing Federal requirements) to distributing the ammo.
So right now, you can send it to his favorite Dealer who as far as I know at this time doesn't have to do anything more than hand it to the person coming in after it.

Local dealer to me charges $35 for a firearm transfer, I know they take ammo transfers, but I don't know how much they'd charge.

The law states COMMERCIAL TRANSFERS

So it may still be legal for a private party to ship ammo directly into the State.

I could be wrong but commercial sales of ammo does not mean individual to individual.

while not a lawyer commercial means a seller who is in the business of selling ammo not your 2 boxes of match ammo that you want to sell. but if we are willing to create restrictions on ourselves and make it easier for nys to deny us our god given rights we may as well give up now. so if i was the buyer id cancel the purchase and tell you where to put that ammo.  now if you are a commercial seller of ammo i can only say you shouldnt be in the business of selling to individuals you should only have nys police agencies as your clients since you are a bootlicker already.

Just send it to the guy's dealer. No reason to decline the sale all together.
