I purchased a sweet Pre Ban Colt HBar  the other day at Gander Mountain. The one thing I want to verify is and I cannot seem to do so is.

Since its a Pre Ban rifle    Can I use any Magazine in it I am able to find, Pre or Post Ban?

They claim I can use any Mag regardless of age.

The search feature is your friend.

The answer however is NO NO NO. Any mag made after Sept. 1994 holding more than 10 rounds is illegal in NY. What firearm it is used in is irrelevant

ETA destroy any hi-cap mag that you have made after 1994. Not that you would have any.

You can only own pre-ban high capacity mags in NY whether or not the firearm is pre-ban is irrelevant.
Unless the mag is a 10 rounder it is NO-GO in NY if it is High Cap and dated 2007 I would get rid of it quickly.

So   Gander was totally wrong     Very Interesting

So can I order Pre Ban Mags Say fromt the Exchange fourm and have them shipped to me?

5 and 10 round mags that were made after the ban are legal. But any hi cap mags made after that are illegal to posses in NY unless you are an FFL.

It is a common misconception often held by employees at such places like Gander. DO NOT take their word as gospel. They are wrong more often than you think. One store employee told me since his rifle was preban he could use Pmags and any other magazine produced after than ban. Then proceeded to tell me that since I bought preban mags and I am using them in a postban rifle, I am committing a felony. Which is false beyond belief.  I'm not saying to trust everything you read on here, but there is a lot of bullshit floating around stores like that

Read this and know it. Don't trust gun shop people for answers; they're normally wrong, and their advice could land you in jail.
NYS Penal Code regarding the AWB http://www.ar15.com/content/page.html?id=24

The pre/post ban status and regulations regarding ownership of an AR15 are clear and distinct from that of magazines. You may use either preban 10+ magazines or 10 round magazines in any AR15; however, only magazines made before 9/13/94 are allowed to be larger than 10 rounds regardless of the status of the rifle. This goes for pistols as well.

Reference your serial number with this list http://www.biggerhammer.net/ar15/ar15serial.html or call Colt directly to find when the rifle was made 800-962-COLT (2658) * Mon-Fri 9am to 5pm EST

I wouldn't solely trust that website, but rather the direct answer from Colt, and they can mail you a letter stating when the rifle was manufactured (lawfully possessed) for a fee.

I too bought an AR from gander and the sales man is explaining all the features of the rifle too me.  He makes his way to the stock and tries to make it collapse.  After it doesn't budge he says "oh, I forgot we pin the floor models so no one steals the stocks".  Send a letter to the company that manufactured your rifle with its serial number and ask for its production date.  If it comes back as pre-ban then rest easy and keep a copy of the letter in a safe place.  If it comes back post ban, rip off the evil features, cry a little, and then move on with your life.

Thanks for the info and good links

I took the mag apart and crushed it in the vice this morning.  I will be going back to try to get them to replace it with a Pre Ban Mag. Since I now don't have a mag.

They seemed so sure of themselves but something told me to keep reading and reading. One of the senior salesman  at the Herb Phillpsons has told me on multiple occasions that NYS permits up to 20round mags. I have tried to correct him and he will not listen. Which just proves the amount of misinformation out there.  Even though he is surrounded by 10 round mags.

So is it legal and do people ship Pre Ban Mags to NYS?

I checked the serial number with the colt listing online and it does come back preban. However I will call to make sure it was an actual rifle at that time as well and get some written verifacation on it.

Yes, it is legal to ship preban mags to NY. Colt only shipped assembled rifles prior to 09-14-1994.

Delete this post and return that magazine to the store immediately.



I would also contact the store manager and figure out what the fuck they were thinking. Also consider contacting the Corporate office of Gander as well.

SORRY TO HEAR YOUR 10 RD MAG BROKE just buy some pre-ban's from the EE some good deals for pre-ban mags

Take said destroyed mag back to gander, talk to the manager, and the salesperson....TELL them YOU OWE ME FOR SAVING YOU A FELONY!

Tell them you are going to buy 10 prebans, and submit the bill to them, If they don't pay it YOU WILL SUBMIT IT TO THE REGIONAL OFFICE!

You will also sign a statement with the local LEO and call the PRESS about them selling BABYKILLING POST BAN MAGS!!!!


Who is the DUMBASS in Herbs giving you this info, I know the managers of most of the stores.
