My father owns a decent sized farm in CNY and has recently gotten quite a few deer nuisance permits for over the summer. We usually take our allotted deer during the season but they are still doing some damage to the crops and there have been more than usual getting hit in the road lately.  


My questions are:

Do normal DEC "Regular Season Deer" laws/reg's dictate the way in which these deer are harvested?

IF not:

Can we use a rifle in what would normally be a "shotgun only" zone? Hunt them at night?

I asked him to ask the issuing agent at the time but he neglected to do so. The permits aren't going to be issued for another few weeks so we've got time to go back and ask. Figured I would ask here first.

The normal hunting rules apply. You cant use a rifle in shotgun territory. Cant shoot them at night ect.

Summer permits will have the terms and condtions right on the permit.   You're req'd to carry said document with you when killing deer pursuant to it.

Generally they allow you to shoot up to 11pm or so, they exempt you from a lot the normal regulations.  If not otherwise stated the "normal" rules apply.  

for instance the permit often allows you to take wild deer at night with a light from a motor vehicle (but not from the roadway).  Remember here for all you who want to shout foul, it's to save the guy's crop and to save him a financial loss.  Fair chase is waived to achieve the goal.  Safety concerns and consideration for the proximity of the neighbors is part of the evaluation before a permit is issued.

No hunting license is required for the summer nuisance deer permits but if you're not the landowner/farmer then you need to have completed a hunter training course and have a hunting safety certificate.  Heck they might even require the landowner to have the hsc now.

I think you're thinking of the other permits for farmers that are used during the regular deer season not the summer deer damage permits.  You are correct for the permits for the regular deer season.

IIRC you can also take the deer with either a shotgun or rifle regardless of the county regs. It will say it on the permit itself.
