Silly question...
Can I replace the USGI followers in my pre-bans with the magpul enhanced followers without losing the pre-ban characteristic? In other other words, will that null them as pre-ban mags? If yes, can I also replace the base plates with magpul ranger plates? Thanks guys. |

It is widely accepted that YES you can replace all the "guts" of the mag...spring, follower, base plate etc. just NOT the body. The body is what classifies it as pre-ban or not. I even heard from the guys in Pro Gun services in Victor that you could theoretically buy a NEW pmag or post ban made 30 round mag to replace an old pre-ban, as long as you destroyed the old mag first. They said they had a letter from the ATF or heard of some letter from the ATF or NYSP saying it was ok... Or maybe they said you needed to send the old mag to the manufacturer, and they could send you a new one as a replacement along WITH a letter explaining the legality in case you ever got caught with the post ban high cap mag... Either way, I don't buy it. Neither should you. |

The mag body is basically the only thing that matters. Replacing anything else is ok.
The old federal law had a provision for replacing damaged prebans with post ban magazines. NY has no such ruling that I am aware of. Most people do not understand NYS Penal law and the grandfather clause, let alone explaining why you have a post ban magazine to replace your worn out preban. Safest bet is to use your prebans until the body is no longer serviceable and just throw it out. |

I have one pre-ban USGI 30 with broken feed lips sitting here on the desk. I bugs me that it is basically garbage even though everything else with it is fine. If it were legal in NY, I would get a new shell and put in the old guts and floor plate. I'll wait to see what kind of impact MacDonald vs. Chicago has (if any). I would gladly destroy it to replace it with a new PMag if the courts ever rule we can. |
| The mag body replacement policy was valid during the federal ban. The ATF letter is not binding on NY courts nor is it authoritative with respect to the NYAWB. Relying on that policy to purchase new PMags or other post ban 10+ mags is very risky and is likely to end in felony charges if caught. |

Quoted: I had also heard of this letter during the late federal ban. Has anyone ever seen a copy? The BATFE, to date, has not replied to my inquiry on this matter. David I've seen the letter and will look for a copy of it. Anyone who says the these AWB related opinions/rules/exemptions/manufacturing variances don't apply or mean anything in NY better hope the hell they do. There is no definition of what the term "copies/duplicates" means in NY nor are there PL definitions or standards to determine what a flash suppressor, grenade launcher, threaded barrel, manufacturer replaced preban receiver etc. is. The ATF also allowed some manufacturers during the AWB to produce postban pistol caliber center fire cowboy rifles with 13 rd tube mags. which are not exempt in the NY PL. |

Forgetting the legal aspects for the moment I've never understood why anyone would bother to replace a mag body when you can still buy USGI NIW preban AR-15 mags for less than $15 each. |

Because the pool of new in the bag pre 1994 mags is dwindling quickly and there are "brothers in arms" all too happy to buy them up and resell them to those stuck behind enemy lines at a hefty premium. I would love to be able to replace my beat up, ratty, no finish USGI mags with $10 Cproducts mags or Pmags. |

That being said, I'm not looking to make money. I'm looking for "like minded people." I have a few NIW preban mags, and a bunch of used ones. I'm willing to help you guys out. My inbox is gonna get fucked!

Not pointing fingers and your recent mag giveaway proves you are not one of the profiteers cashing in on the misfortune of those stuck with AWB's but I have seen in the EE people asking $45 for a single date stamped preban mag. There was an ad yesterday for a Glock 17 mag for $65. Granted these prices would not be sustainable if the morons didn't buy at these ridiculous prices but don't pat yourself on the back as helping out "brothers in arms" while slipping the knife in our backs. End of rant. |
