I was of the understanding that whether it was a flash hider or brake/compansator was dependent on the exit hole. If it was wide open, it would be considered a flash hider (not legal). If the exit hole was only slightly larger than the projectile (in other words a closed end), then it was a brake/compensator and would be legal providing it was permanently installed (pinned and welded or silver-soldered).

Just an FYI but if you did get a Surefire Comp of some sort, people usually charge extra to get it pinned because its supposed to be alot harder to pin than the normal break. Or atleast ADCO says that

I don't know details of the NJ ban, but all SF attachments are suppresor mounts too, so that feature would ahve to be altered as well..  (here in NY)

Short answer....If a muzzle device suppresses the flash, it is a flash hider.

This may or may not pertain anymore.

I wonder how the ATF decision on teh fsc 556 jives with this line from your link:


While certain devices are exclusively designed as flash
suppressors, many other muzzle attachments are designed to perform
multiple functions such as a combination flash suppressor and
grenade launcher, or a combination flash suppressor and muzzle
break.  Any such combination devices which function as a flash
suppressor would qualify as a flash suppressor for purposes of
section 921(a)(30)(B)(iv).

Recently someone asked about the Miculek brake, I have one so I said:

"+1 works great
+1 loud as hell(aren't they all?)
+1 on being required to be welded/pinned on in NY
Being poor enough to only own one AR sucks, because at the NYS Rifle Championship at Square Deal Practical Shooters(every spring) my Miculek works great, but at an 8+hour MDTS carbine class I need advil before, during, and after the 700ish rounds. I have watched this Noveske in use and was amazed at the recoil reduction, since it has no ports. The reduction and how the description states you and anyone close by won't be eating muzzle blast( and the dirt that goes with it), sold me.
EDIT: The write up says flash suppresser, but with no slots, ports, etc. I don't think anyone would know what the hell it is.

uh the KX3 is a very known FH, i wouldnt recommend putting one on an AR

I read somewhere that if the slots are horizontal it a FH and if slots are vertical it's a MB. That looks like a  brake to me. Also, if it was a FH it would be legal if it was the only banned item. Just my .02.

It does not matter whether you think is it a break or not, its classified by the BATFE as a flash supressor

So what is a muzzle device with round holes? As Zerothomas said, it's all about what the BATFE thinks it is. Your best bet is the fsc556, the BATFE has deemed it a MB.

dntc is freakin awesome I have one but the one I have is designed for the AK so it has a .30 hole in it lol but it sure kills the recoil.

The MB556K is a break not a flash hider. I wouldn't hesitate to put one on my SR but I have already purchased an SEI muzzle break.
