Yeah I know, 5 initials you don't see together often....... A big reason I haven't SBR'd anything is I travel to NJ and PA alot and sometimes like to shoot with family (PA would allow it but NJ wouldn't) but still wouldn't want the hassle of more paperwork all the time. NJ does on the other hand allow AOW's and I believe that I read somewhere that you don't have to fill out a 5320.20 for AOW's (assuming that's correct) When you have a title 2 registered firearm does that supercede any title 1 firearm laws? This is why I ask, As a title 1, I wouldn't be able to take a CA89k to NJ, but if I had a ClassII smith transfer it to me as a AOW would it be allowed since it's now a AOW? Here's how the NJ AWB is written >>a semi-automatic pistol that has an ability to accept a detachable magazine and has at least 2 of the following: an ammunition magazine that attaches to the pistol outside of the pistol grip; a threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer; a shroud that is attached to, or partially or completely encircles, the barrel and that permits the shooter to hold the firearm with the nontrigger hand without being burned; manufactured weight of 50 ounces or more when the pistol is unloaded; and a semi-automatic version of an automatic firearm<< The CA89k pretty much fails all the above, BUT AOW's are legal, so if it's an AOW is it legal to take into NJ or not? (This is all assuming 15rd mags) I'm thinking if it were legal people up there would be doing it already, but who knows.... Are the only AOW's allowed shotties? |

if something is a named assault weapon in NJ, you need to apply (and will be denied most likely), to the Superior Ct for a permit to own the assault weapon. So I think youd be outta luck. Not sure on AOWs but again if its an AW, its no go unless licensed which wont happen. |
No offense, but it's a pretty AOW/NFA specific question From doing research it looks like people that SBR'd during the federal AWB had to comply with no flash hiders, so that's leading me to believe it might not be acceptable, but on OTOH MG's don't have to be SBR'd cause they're MG's so I need to know if an AOW is an AOW or a semi automatic pistol. By definition it's not a pistol it's an AOW so the semi-auto pistol guidelines shouldn't be applicable, the ATF is very clear on what's what. BUT in the NJ semi-auto "assault pistol" guidelines it specifies you can't have a forward grip on a pistol, this is a no brainer because it's illegal on a federal level as it constitutes an AOW which is legal to posses in NJ if it's obtained properly. |

Forget what you read about AOWs being legal in NJ. Some may recall that I had a federally approved 14" Mossberg 590A1 AOW. The NJSP said it was a shotgun, even after showing them the NFA law. Even as a dealer, I had to disassemble it then sell it off. The only legal NFA allowed to be owned in NJ by non-LEA is full-auto by an FFL. I know of no one else owning one, but I am sure they are out there. A permit is required under NJS 2C:58-5. LEA can own any NFA. Good luck. |

Thanks for the reply PK, that sucks about your AOW... For a night I thought NJ had a little hope! So on a MG, your saying about the permit, you would need that on top of the 5320.20 just to visit NJ? (not that I would want the hassle or expense of a MG) I'm quickly remebering why I gave up so long ago! All the short visits and the internet were starting to make me think it wasn't so bad afterall... I'll just stick to plinking .22's up there |
