Simple Question? Can you own an ar15 Pistol in this state (NY) and if so does it have to be built on a preban lower? If you build it on a preban lower can you have a threaded barrel or a shroud (Handgaurds) Also can you do a Custom Build on a pistol lower if it conforms to the weight requirements? Thanks for the help and knowing this crazy state thier is no clear answer but you guys have always steered me in the right diredction before. Hopefully you can help me with this |

If it's not going to be under 50 oz as manufactured (without magazine and optional optics) and be barrel-shroud-less, then not only does it need to be on a pre-ban lower, that lower must be a pistol lower, never having been used as part of a rifle, and transferred as a pistol. You can also have a post-ban, but it needs to be under 50 oz (not very easy with aluminum upper and lower) and not have a shrouded or threaded barrel. Bushmaster makes a Carbon 15 model that's legal here behind enemy lines. |

You can build one on a preban PISTOL lower if you can find one ( best of luck ). As far as current production goes, you can buy a Bushmaster carbon-15 pistol but....... you have to get it without a mag ( the new mag will not be NY compliant ) you have to get a model without a barrel shroud ( handguard ) you cannot have a flash hider or threaded barrel ( the Bushmaster has a brake on it that is quick disconnect , not threaded ) you have to get one under 50 ounces ( Bushmaster does make one, the Type 97 ) www.bushmaster.com/catalog_carbon15_AZ-C15P97.asp Basically , if you read the NYS assault weapons laws pertaining to pistols, the type 97 is just about the only type you can have unless you go preban. Professional Ordinance made them before Bushmaster took them over but I hearworse things about the originals than the current ones made by Bushmaster. I have a Bushmaster and it's a blast to shoot. It'll take any preban mag you want to stuff in it and functions fine. I did have to send it back to them once because the barrel nut was over torqued when manufactured ( so they said in the little note they sent it back with when it was fixed ) and it stress cracked the upper just behind the barrel nut. Pat that , it's a nice little gun. My only beef is that it's got the stainless barrel and not something parked or muted in black or dark gray. Eventually I'll have the barrel coated when I grow balls big enough to take the barrel nut off and figure out a tool to do it ( it's an odd size and proprietary to this gun ). Right now there is a preban Olympic Arms OA-93 on Gunbroker but it's a good piece of change. It's not mine but I was looking at it today whilst surfing gun porn. I would also check your local licensing agency to be sure it's going to be able to go on your permit BEFORE you buy one. I've heard of certain counties giving folks a very hard time with this type of pistol ( SUFFOLK ). |
