I would ask if they consider it to be a brake or flashhider. To me it looks strictly a compensator.

That is a muzzle brake aka compensator, not a flash-hider.

Pretty Sure ATF sees it as as compensator due to its design and lack of hiding flash. Seen one on a M4gery at an indoor range in PA. Definitely brightened my day because my lane lights were partially out and he was the next lane over.

That's a Compensator  i have the same one on my own AR..  Generally anything that has a restriction at the muzzle end qualifies as a "Compensator"  there are a few companies that have different Hiders that they cover across the front except for about a .30 hole for the round to pass through.  From the side they look like standard Flash Hiders.
