hey im taking a trip in march to NYC and i always hear about how crazy the weapons laws are there so i figured i would ask.
What are the laws regarding carrying a pocket knife if any?
(can it be visible?)
(length of blade?)
(type of point?)

any insight would be great thanks

NYC has different laws than the rest of the state, but I believe that I put the correct answers in red above. I'm sure someone who knows them exactly will chime in...this is just from memory though so don't count on them.

has to be concealed?  Not sure about that...

I know in the rest of the state you can have a folder with the clip portion on the outside of say a pocket or belt clip.  Hell ive seen sheathed knives and small utility knives also.  This is upstate of course, but not so sure about the concealed requirement...hmmm NYC ppl where are you guys?

In NYC a folding pocket knife must be carried concealed and the blade is required to be LESS THEN 4" in length. Double edged bladed knives (daggers) are illegal in NYS.

one last question, are there any issues with concealed carry in an establishment that serves alcohol? The reason i ask is FL has restrictions on its CCW about that.

Are you talking about a firearm or a knife at this point?
you can carry a knife in a restaurant/bar...a handgun? no.

I'm sure he means a knife. I've never heard of any restrictions in NY like FL has for knives or other devices/weapons  carried with a FL CCW.

You can carry a knife,no problem. Automatics are illegal in ny but thats about it

Possess. They are considered "daggers" and are named in the Penal Law.


§ 265.01 Criminal possession of a weapon in the fourth degree.
   A  person  is  guilty of criminal possession of a weapon in the fourth
 degree when:
   (1) He possesses any firearm, electronic  dart  gun,  electronic  stun
 gun,  gravity  knife,  switchblade  knife,  pilum ballistic knife, metal
 knuckle knife, cane sword, billy, blackjack, bludgeon,  metal  knuckles,
 chuka   stick,   sand  bag,  sandclub,  wrist-brace  type  slingshot  or
 slungshot, shirken or "Kung Fu star"; or
   (2) He possesses any dagger, dangerous knife, dirk,  razor,  stiletto,
 imitation  pistol, or any other dangerous or deadly instrument or weapon
 with intent to use the same unlawfully against another; or
   (3) He or she knowingly has in his or her possession a rifle,  shotgun
 or  firearm  in  or  upon  a  building  or grounds, used for educational
 purposes, of any school, college  or  university,  except  the  forestry
 lands, wherever located, owned and maintained by the State University of
 New York college of environmental science and forestry, or upon a school
 bus  as  defined  in  section  one  hundred forty-two of the vehicle and
 traffic law, without  the  written  authorization  of  such  educational
 institution; or
   (4) He possesses a rifle or shotgun and has been convicted of a felony
 or serious offense; or
   (5)  He  possesses any dangerous or deadly weapon and is not a citizen
 of the United States; or
   (6) He is a person who has been certified not suitable  to  possess  a
 rifle  or  shotgun, as defined in subdivision sixteen of section 265.00,
 and refuses to yield possession of such rifle or shotgun upon the demand
 of a police officer. Whenever a person  is  certified  not  suitable  to
 possess  a  rifle or shotgun, a member of the police department to which
 such certification is made, or of  the  state  police,  shall  forthwith
 seize  any rifle or shotgun possessed by such person. A rifle or shotgun
 seized as herein provided shall not be destroyed, but shall be delivered
 to the headquarters of such police  department,  or  state  police,  and
 there retained until the aforesaid certificate has been rescinded by the
 director  or  physician in charge, or other disposition of such rifle or
 shotgun  has  been  ordered  or  authorized  by  a  court  of  competent
 jurisdiction.
   (7)  He knowingly possesses a bullet containing an explosive substance
 designed to detonate upon impact.
   (8) He possesses any armor piercing ammunition with intent to use  the
 same unlawfully against another.
   Criminal  possession  of  a  weapon  in the fourth degree is a class A
 misdemeanor.

In NYC knives must be FULLY concealed.  If your knife has a clip and it is clipped to the inside of your pocket with the clip visible, it's a "no-no."

There are certain knives that are legal to carry in NYC, but in speaking to many NYPD LEO's (many, NOT all), they either don't know the law, or dont care.  If you have a knife, they're taking it away at best.  Make sure it's well concealed.

yes i was talking about a knife still and you guys have answered all my questions.

just to bring a little clarity to my previous comment. In FL even with a CCW you can not carry a firearm in to a bar. Not knowing any of the NY laws, i figured i would cover all the possible situations. Knowing is half the battle...
FL doesnt care how you carry a knife as long as the blade is not longer that 4in.

Just a bit of real world advice in addition to the laws which have been mentioned. When they say concealed they mean truly concealed including the pocket clip. Just make sure to either unclip it and drop it into your pocket. I usually carry an AO when I have a knife and since im not crazy about having one loose in my pocket I have lately gotten into the habit of just clipping it IWB in the exact same spot as I carry my pistol.
