| I live in Buffalo and I read a article in Stars and Stripes about a guy being arrested for having 20 or so long guns and thousands of rounds of ammo. He also had 3 sets of body armor. I am currently thinking about stocking up on ammo because of the rising prices (.308 for .50 a round) and I also have 7 long guns and am about to get a few more (PRE BAN UZI). So does anyone know of the laws pertaining to how many rifles/hand guns and/or how much ammo you can keep in your home at one time? |
newbie. I'm not familar with Buffalo city limits laws but there is nothing on the state books to prohibit such. I would imagine the guy in question was doing something else that drew attention to him. Do you have a link to the article? |
Yeah, there is always more to the story. The guy probably got busted for selling drugs or something, but the news would rather report about all the evil guns that he had, lol. |

yeah like the dip $hit in the next town over from me who had a DWI and his porole officer visited him to find a loaded gun by the door. they freaked out and called for the swat.lol they found a few long guns(nothing major) and a spent WWII rocket launcher(the kind you shoot once and throw away). The news and a friggin field day with it. claiming he had an arsanal and explosives(gun powder) and rocketlaunchers(failed to mention it was just a relic and not a live unit). the best part was when the sherrif came on in a interview and flat out said..."we dont care why he had these weapons, weather hes a hobbiest or what ever, he was a major threat to the comunity and i feel safer with him behind bars" ......wait.....so your saying it dont matter why you have guns...but if you do your a threat and should go to jail???? that one made me cringe |
+1 Nothing in the PL but maybe something having to do with town or city ordinance. Like the city and having I believe over 100 rounds is against fire code. Would love to see the link on this.

Anyone watch the news stocks over the last couple of months? They are crashing because we are winning the war in Iraq and they have no bad news to report. It makes me sick actually since all they want to do is report bad news and cost the lives of our soldiers. here you go boys straight from the books § 265.04 Criminal possession of a weapon in the first degree. A person is guilty of criminal possession of a weapon in the first degree when such person: (1) possesses any explosive substance with intent to use the same unlawfully against the person or property of another; or (2) possesses ten or more firearms. Criminal possession of a weapon in the first degree is a class B felony. |

I asked about it during my police academy when we were going over PL, the instructor was about as confused as I was. |

Whats a firearm as defined in PL 265? Firearms = "NYS Assault weapons"? Firearms = "ATF definition" of "firearm", Firearms= handguns? I call bullshit that its illegal to own over 10+ guns unless your "licensed or exempt". License as in 03 FFL, 01 FFL, NYS Pistol Permit, ???? need clarification if you could provide more info on this. I think we are ALL thoroughly confused now. |

Firearm does not include an antique firearm. |
gee so stuff thats illegal under federal law (such as non-registered SBRs, SBRS, SBS, non registered SBS, etC) are all illegal in NY...and owning 10+ of them is a felony in itself, shocker ![]() thnx for the clarification to the thread/posts 762DM, now at least we can safely say none of us are breaking the law by simple ownership of a quantity as we feared a bit ago. But again its only if you have a SBR, SBS, etc right? You can own say 12 Mosin Nagants or 12 pistols on your permit and your fine. Want to further clarify, cause how its being made sound is simply posessing 10+ guns is illegal...and that doesnt make sense. |
The PL defines what a "firearm" is and prohibits its possession unless you fall under one of the applicable exemptions listed in "Section 265.20 - Exemptions". Possession of an SBR or SBS is illegal unless you are exempt in accordance with "265.20". A legal length Mosin Nagant is not defined as a firearm in "PL § 265.00 Definitions" so " PL 265.04" does not apply no matter how many rifles not defined as firearms you possess. A pistol or revolver is defined as a firearm in "PL § 265.00 Definitions" so " PL 265.04" does apply unless you fall under one of the exemptions as listed in "265.20". One of the exemptions listed is "Possession of a pistol or revolver by a person to whom a license therefor has been issued as provided under section 400.00 or 400.01" so "PL 265.04" does not apply in this case. There is no limit to the number of pistols/revolvers you can possess as long as you are licensed or meet one of the other exemptions listed in 265.20. I know it's confusing but that's the way these statutes are written. When reading a section of the PL you must read all the sections of the PL that apply. |

it IS true that it's a felony to own 10+ firearms. You just happen to be exempt due to the fact that you have a pistol permit. |

There are no limits to the number of handguns you can own if you are licensed or otherwise exempted, and there are no limits to how many rifles or shotguns you can own so long as they don't fall under NFA rules or violate NY laws; i.e. no SBR's, SBS's, or post-ban "assault weapons." |
