Hello all,

I'm sure this has been asked, but of course, I can't find anything.

I'm selling a post-ban Bushmaster XM-15 lower.  I live on Long Island.  I have a potential buyer from Jersey that want's to come over and do a FTF.  Am I allowed to sell a firearm to someone FTF if they're not from NY?  I plan on making the person sign a "receipt" confirming that they have taken ownership of the firearm and that I am no longer the owner and claiming that they are legally allowed to own a firearm and blah blah...

So is this legal?  Thanks in advance for all of your continued help!!

If the buyer was from NY you would be fine.  Since he is from out of state it the transaction must go through a FFL holder.

Bushman is correct. The firearm needs to go through a NJ FFL's bound book.
Now that doesn't preclude you from personally delivering it to a NJ FFL (letting him also make a copy of your NYS drivers license.)

Why not kill multiple birds on one trip? Bring the lower to the Blast on February 9th, and arrange to meet the buyer there so that PK90 can do the book transfer and NICS check.

Hmmmm..I can bring my AR into New Jersey and go to the blast without automatically being sentenced to death?

No.  There will be a kangaroo trial FIRST.  Then you will be sentenced to death.

The transfer can go through an FFL in either state as long as the buyer completes the 4473, passes the NICS and the rifle is legal for possession in the buyers state.
The FTF sale IS prohibited.

Actually...

A NJ buyer can purchase a non-NJ-legal long arm from an FFL in another state, as long as he passes a NICS and completes both a 4473 and a Certificate of Eligibility (with the information on his address-matching NJ FID card)

He just can't legally bring it back into the PRNJ

Could you please explain why.

NJ can't enforce their laws in another state.  Plenty of NJ residents own NJ banned firearms.  They just keep them out-of-state.

Well that explains it................ I really wanted to know what the NJ law is that specifies a firearm cannot be purchased and brought back in to the state.
