I hate asking this because I've seen it so many times before and it seems that 50%+ of new posts in our hometown forum are related to legalities, but here we go...

Assuming that the FFL will accept it, there is nothing illegal about sending an out of state handgun to an FFL here via FedEx correct?

As far as I know, an FFL can receive a firearm from anywhere, provided it is legal in the state where the FFL is.  Check with the carrier though, as some of em won't ship handguns.  UPS will, but it had to be taken to their dist. center to be shipped.

speaking from a strictly legal and not moral standpoint it is legal to ship through FedEx/UPS/DHL without notifying the carrier (unless you are a licensed FFL) correct?
Not saying this is the best course of action since insurance coverage would likely be nullified...just speaking to federal law. I have a gun that I own that is currently out of the state that I would like to transfer in, but I have to ship it in. Seems that I'm going to have to take it to the big FedEx center and have it shipped from there. I already have a copy of the receiving FFL as it seems they will ask to see that.

NO NO NO NO NO

An FFL (federally licensed, remember?) can receive firearms that are NOT legal (for civilians) in his business location.
He can't sell those same firearms to civilians in his state, but there's nothing to preclude him from selling them to LE agencies and to other FFLs, both in and out of state.

I saw a very nice M1 carbine last evening at my favorite FFL's place, as we discussed the assholishness of it being on the NJ banned list (which was the source document that Klinton's 94 AWB grew out of) yet it remained legal for the rest of America.
I can't take it to the range and fire it, but HE (as the FFL) can.

As I said, as far as I know.  Thank you for the correction Joni.  And to the posted question, legally, yes you need to notify the carrier that there is a firearm in the package.  However I would check with a lawyer, because if it is legally yours, and you purchased it out of state, I assume you were not a resident here at the time.  If that's the case, then I don't believe you would need to ship it.  Like if you move out of NJ, you wouldn't need to ship all your firearms to a FFL in your new state of residence, would you??

You only are required to notify a common carrier if you are shipping a gun to an unlicensed person.

If you are shipping a handgun to a NY FFL/NY Dealer in Handguns the NYSP state on their website that it must be shipped FROM an out-of-state FFL to a NY FFL/NY Dealer in Handguns. If your receiving FFL in NY doesn't care then I wouldn't worry about that requirement as it's his problem and not yours.

If you move to the Peoples Republik of NY you do. That is unless you're a gang banger, crack addict, convicted felon, rapist, bank robber, hit man, child molestor etc.
