In theory, as long as the lowers in the possession or control of the same person as the upper you describe do not have either a collapsible/folding stock or a pistol grip, a NJ prosecutor could not charge that person with possession of a assault weapon.

But if your lower accepts detachable magazines and has a pistol grip (as most NJ lowers do)
then possession of the described upper could land you in a world of shit if you were caught.

so no kind of suppressor or break is legit in our fine state hu? i always thought that those pinned and welded ones were fair game, that sucks

A brake is not a flashider. A pinned and welded "brake " is perfectly fine. A flash supperssor  like a CAR15 type is fine too as long as the "slots" are filled.

a flash suppressor and a muzzle brake are two different things.

1)
you may not have a flash suppressor if it will make the gun into an "assault weapon" as defined under NJ state law.

2)
you may have a BATF-approved muzzle brake as long as the rest of the stipulations of the NJ state AWB are met as well (e.g. the brake is permanently attached, the overall barrel length including the brake is 16", etc).

Permanently attached threaded muzzle brakes are ok on threaded barrels.
Taper pinned slip-on muzzle brakes are ok on plain barrels.

Flash hiders or flash suppressors are an 'evil feature' in NJ, and on a semiauto rifle that accepts detachable magazines, you're only allowed ONE evil feature from the list:
-pistol grip
-collapsible or folding stock
-bayonet lug

So unless you're willing to remove your pistol grip (which would make it tough to fire your AR) or rivet a magazine into the magwell, you can't legally have a flash hider or flash suppressor on an AR in NJ.

It would appear to be an ok muzzle attachment for a NJ-legal AR as long as it's permanently attached to your threaded barrel.
