Guys
always thought class2 was no no in NY state.  Had a debate with a leo who insists he has them legally (and they are not for duty) and swore I could too.  Which one of us is all wet on this?

His employer has to sign paperwork stating its FOUO at some point in the procurement process.

Yes,you can have Full-auto in New York state. It requires Incorporating yourself as a business. There are many details, but its fully legal to do it. In fact, my friend is getting ready to do it full-time. He will be able to own and manufacture full auto and suppressors in his shop. Of course, they can only be sold between other Class 2 dealers and Police, military, and goverment agencies.

Ever heard of Auto Ordanance in West Hurley, NY, the manufacturers of Thompson submachine guns? They are a class 2 manufacturer.

See the link at the top of the page for legal references?  Go to the New  York Section, then scroll down to Section 265.20 of the Penal Law.  It tells you who is exempt from the section of the New York Law making posession of machine guns illegal as well listing exemptions from the illegal posession of other items.

I know of a few Class2s in NY. Not common, but possible.
