I read the post below about the effect of the sunset on NY (unless our laws change, nothing will change for us). I curretly have a new postban receiver begging to be assembled. I'm trying to decide if I should wait for the ban to sunset under the hope that NY would need to follow the federal laws to make policing feasible. If the federal law sunsets but the NY law doesn't, I think enforcement becomes very difficult.

Based on the other thread though, perhaps I'm being overly optimistic. Should I not bother waiting, and simply build this up into a postban configuration? The other interesting option is to trade it for a pre-Klinton receiver once the ban sunsets.

What would you do? Thanks...

pre-94 trade-up will be wise once it sunsets.
I seriously can't imagine the enforcement of this law after the sunset. Not like anyones even been charged with breaking this stupid law up until now, I doubt anyone will be- ever.

Statistically speaking, you might as would set it up as a pre-ban now and keep your mouth shut. I'm not encouraging it, I'm just saying odds are nothing will ever come of it.

The law will not be enforced IMHO

BUT,

You have one run in with some law enforecement entity for any number of reasons..
You use your carbine in self defense of your home...
Your rifle gets stolen and recovered...
The list goes on, all it takes is one to know the letter of the Bullshit laws and then your screwed..

We NY'rs need to fight this and get it off the books. Be it the NRA or SCOPE, we all need to put forth effort on this...

Yup, use the gun in a shooting, get into a car accident and end up hospitalized and your car gets inventoried, have a fire at your house while you are gone and the cops look over your guns, the gun is stolen then recovered by the police, of course they check the serial number as a matter of routine and find out that it's a post ban, etc etc.

And don't assume that all police in NY are ignorant of the AWB. I know a guy in a local 5 man PD that knows all about the state and federal AWB, I heard him bring it up and explain it correctly to another officer.

I'd wait until after Sept and buy a pre-ban

Federal law is the law of the land (USA).
Any and every state must follow it.
Any state can and usually does add or impose stricter wording that is only enforceable in that state.

I do not see any reason why NYS will abolish the AWB ever. It is much easier to pass a new law then to abolish it. It would only come to consideration if the overwhelming majority of the people of the state demand it. This will not happen in NYS in my opinion, as much as I want it to go away.
Look at machine guns. It is perfectly legal to own across the land, However many states have chose to adopt laws banning them in their state, therefore making them illegal in their state.

Well, atleast we can finally get dirt cheap mags. That's something that is absolutely un-enforcable on the local level.

Uhh, apparantly you've never read about the bans on full cap mags in states such as NJ, or Kali, huh??? Don't think it couldn't happen here in NY, too - as long as we've got liberal politicians, we HAVE to watch our gun rights like a hawk... I predict that after the sunset, the libs will begin a movement against full cap mags, and to shut down inter-state ammo sales - ESPECIALLY in NY... Buy your mags and ammo while you can - just in case...

There are already restrictions on hi-capacity magazines in Buffalo Rochester and Albany, I believe.

Albany also has, get this, a local law that supposedly requires you to request in writing permission to the police chief if you want to carry a pistol in Albany,even if you have an otherwise valid NY state pistol permit. I would bet $ 100 that the police have no way to process such an application nor has anyone ever sent one in, I keep meaning to send in 365 of them for processing.

We in the Buffalo area have no such folly, beyond matching the federal AWB manufacture date for pre-ban mags.  Don't know about Rochester or Albany.

Hopefully the sunset brings a flood of pre-ban hardware our way at firesale prices.  That would be poetic justice for the BS state laws.

Just found the hometown forum....very interesting to see what happens across our lovely state.

NY won't reply the state level AWB, and with guns it will be easy to run the serial number and find out the gun is post 94 and illegal.
