I just moved to TX on August 26, and I'm trying to apply for my CHL.

My CHL instructor (and several people on ARFCOM) have told me that the six month residency requirement has been removed, but when I get to the end of the CHL application online I get:


Affidavit
Eligibility Statement

I, <snip> , hereby swear or affirm the following:

I satisfy all the eligibility requirements listed under 37 TAC Chapter 6, and Chapter 411, Texas Government Code.

This includes:

       I have established legal residence in the state of Texas for the preceding six months (resident license only) or
       I am eligible for a license as a non-resident under Section 411.173(a);

Have they just failed to update the website?

Either way, I'm not comfortable signing something, even online, that I know to be false.

I tried calling the phone number listed at https://www.txdps.state.tx.us/rsd/contact/default.aspx, but they are closed.

Have ya read 411.173(a) ?   It will answer your question

Texas Government Code
Sec. 411.173.  NONRESIDENT LICENSE.
(a)  The department by rule shall establish a procedure for a person who meets the eligibility requirements of this subchapter other than the residency requirement established by Section 411.172(a)(1) to obtain a license under this subchapter if the person is a legal resident of another state or if the person relocates to this state with the intent to establish residency in this state. The procedure must include payment of a fee in an amount sufficient to recover the average cost to the department of obtaining a criminal history record check and investigation on a nonresident applicant.

If you are going to live here and have signed a 1 year lease you have met the intent part... the only way you wouldn't is if you already have plans to move elsewhere... I filed before 6 months of living here and I called the DPS about this same issue.. they told me it was no longer a requirement to wait 6 months and so I filed...

I wouldn't worry about this part as long as you intend to live here you are good.. if shit happens and you have to relocate elsewhere for whatever reason you are still good to go! The part you want to worry about is the Criminal Records/Arrests...make sure you list everything you are required to!

I think you are missing the point.. a LOT of people do not like the wording on laws, legal forms, legal applications.. not that they disagree with it, it's that it's confusing to them...all I am saying is he doesn't need to worry about this part if he is intending to live here in texas he can file right now for a resident chl and does not have to wait 6 months.. I called and asked the DPS because like I've said before they had conflicting information on their site.. I've also sent them emails regarding what things should be included in FAQ and things that needed to be fixed.. Pretty sure they have updated some stuff.. a search online form some news sites confirmed the answer the DPS gave me...

Giving people the LAW isn't exactly helping in many cases... being in the 95th percentile I understand a lot of legal mumbo jumbo better than most.. but even I get confused sometimes.. you should focus more on trying to simplify things for people rather than trying to prove you are smarter.. I think that is why a few people on here don't like you... to me I wouldn't call you a best friend, I'd say your a CHL NERD.. and that's a good thing.. but please try and understand that everyone is not smart at everything and the wording of the law confuses many, even cops/judges/lawyers  you can find case & points for each of those.

I didn't worry about anything on my application.. I was confused about being arrested having that arrest expunged and whether or not I had to legally disclose that information on my application.. but was I worried about it.. NOPE.. because I chose to list it and let them decide whether I should have included it or not, because I didn't want to waste money on a lawyer and I wasn't trying to hide it... If you have to WORRY about a CHL application imo you probably shouldn't be filing for a CHL!

Look at the sticky Mate Frio knife thread for example of many people confused over the LAW.. aren't there cops, chl instructors, etc all confused... they write them like that on purpose.. I'll let you figure out the reason why!
