| I let my neighbor and his kids go fishing in one of my stock tanks. ( pond fer Yankees). Any how ,come to find out during our visit, he was arrested for being in possession of a firearm. He had gotten into a fight ten plus years ago according to him. Regardless several months ago he took a rifle to get worked on and was arrested after he left. Idk/ c the details but the crazy part is batfe confiscated all his firearms and then contacted him a couple of weeks ago to inform him they had to return his firearms due to the fact the governor had signed some form of legislation stating Federal law could not trump Texas law with firearms. I guess the state law letting people slide after 7 years on a domestic violence is worth something now....idk. Just thought it was about the strangest thing I have heard in a while. I hope this helps out some of these guys that got in a fight or whatever when they were younger. If its true. Anyone else have a similar incident or know anyone that has had this happen? |

He visited with a attorney . He did not retain one. Sorry about the lack of details. It is just what I was told. I didn't ask for a badge number or what color the agents eyes were to smell his finger or anything else. I however did see the raid taking place at his house a few months ago. It is about a half mile down the road.

He got into a fight, or beat his woman? You reference domestic violence, but it is a permanent dis-qualifier for possession of a firearm. I am not familiar with any legislation that would allow a person to violate federal law while residing in Texas. Federal laws don't trump state laws; they are enforced in separate jurisdictions by different agencies and prosecuted in different courts. I do not believe any such legislation exists. Also, what law lets "people slide after 7 years on a domestic violence"? |

According to him it was a fight. Not beating up his ol lady. Also only permanent federally per him? Again idk. This whole thing is strange to say the least to me. That's why I posted. If I hadn't seen the raid and then heard him shooting on his property today. I would call bullshit. We need a abogabo or atf agent to she'd some light on this.

"Fights" Do not get you domestic violence convictions. DV conventions are permanent dis-qualifiers. AFAIK, there is no Texas law regarding this. A fight will not get your firearms taken unless it is a felony, and that would be an aggravated assault conviction to make it a felony, or something like attempted murder, etc. Federal law makes the firearm restriction forever. Texas makes it forever, except for your house, which lasts 5 years. So after 5 years a person could not be prosecuted under Texas law for possession of a firearm at his residence, but he could under federal law. |
