So, my father in law was in a situation the other night where "his life flashed before his eyes," and he is realizing he needs to have a will done. The last time I dealt with a will was when JAG wrote one for me. Can someone give me some advice to pass along to him? |

When he gets one drawn up by a lawyer it should be dated and signed by the father in law. He needs to keep that page. If he has multiple copies made he needs to keep the original in a safe place, especially the signed last page. Otherwise when the will goes to be probated the Probate Court will make his heirs pay big money and go in front of a judge with a lawyer because the will and signed page are duplicates and not the original.
If the will doesn't get probated he will have died "In Testate" which is not a problem if his heirs are civil to one another when his will "matures". In that case they devide everything evenly amongst themeselves, hopefully with no squabbling. |
