Ok here is the deal. My ex wife calls to tell me she bought a new pistol.
She has been in mental hospitals a few times.
So I asked her if she bought it and she said that she had her BF buy it for her.

Whenever there is any doubt, there is no doubt.

I think you know the answer already.

It is ONLY a straw purchase if the buyer is buying it for someone that can't legally buy it. Giving a gun as a gift is fine. OP has she ever been committed on an order of protective custody? Is she a drunk or drug abuser? Do you think she is a danger to herself or others?

Depends on whether the mental hospital visit was voluntarily. If she was involuntarily committed, then it was an illegal straw purchase.

She was committed after a suicide attempt

Maybe you should feel her out as to what her motives were for buying it. It may save you from regret and self blame later.

I would call the chief leo and let them know. I am a MYOB type but this is now your business too.SS

#1. Why in the hell do you still talk to your ex?!?!?!  You divorced her, keep her out of your life.

#2. There is too little info to make a determination.  After she attempted suicide, did a court or council commit her, or did she go voluntarily for treatment or something else?

#3. I'd drop a dime on her and the new BF... crazy people and guns are a terrible mix as we have all seen this week.

I second that, don't ever talk to the ex.  You divorced them to get rid of them not keep them around.

Admission to pysch after a suicide attempt is mandatory.  This was an illegal purchase.  I prefer to MYOB but she made it a point to tell you.

...that phrase "She has been in mental hospitals a few times" leads me to believe
she has had more than one documented psychiatric episode aside from the attempted suicide.
My question is if you both share joint custody of any children from the marriage. If you do I would be making an
appointment with an attorney.

As far as the straw purchase - good luck proving that in court. It was gift from the current boyfriend.

No if the BF lied on the 4473 about about who the actual purchaser was, it is a crime regardless of whether the recipient can legally buy or not. On the face of it is sounds illegal, but there really is not enough info, the BF could have given it to her as a gift, and she might not be prohibited (being evaluated after a suicide attempt is not enough for a DQ).
I cannot believe so many people would drop a dime on her. When has calling the cops to report someone has a gun ever worked out?

If you share kids, I would get them TFO.

On a side note:

It could be a cry for help.

Assuming she knows:

She shouldn't have it.
You know she shouldn't have it.

Either way, it's all messed up.

You need more info to determine what is going on.

having read this, I'd call it a straw purchase to a prohibited person, or in simple terms a "felony".

doesn't it have to be a court order?

If the court orders it, then that person cannot legally own a firearm.

Which state was it in, Texas?

I don't know if that would prevent her from legally purchasing or possessing a firearm.

I don't see why you care.  She is an ex so there is no need to talk to her or care what is happening in her life.  Unless of course you two have kids together.

Then again she could be lying about the whole thing, due to recent events, and be screwing with you.

Never been divorced, but this comes to mind:

"Officer, I did not get a gun and I did not tell my ex that I did"

If no kids, think REAL HARD before reporting anything. If kids, talk to the lawyer first. Record date and time of conversation.

Yes, of course. There is no evidence any laws were broken.

I could care less if it was a "Straw Purchase"
Thats a Fed issue..

If you have kids with this woman - contact an attorney...
especially if she has a history of being a nut case.

If no Kids and you are divorced .....

WGAF !!!!
