So this weekend I tried to purchase a Glock. I as told after filling out the 4473 that there would be a waiting period. Now I have purchased firearms before and never had to wait...which brings up another point. I was arrested about 3yrs ago for theft, I was given probation and completed successfully and my felony was downgraded to misd defered adj. As soon as I was complete with probabtion I bought my AR. There was no problem and no wait. But now that I was trying to purchase a handgun there was a wait. I was afraid that If I paid for the gun then get denied there would be a 25% "restocking fee" and no glock . So now I am wondering if there is something else going on or if it was a legit wait and I would get it a couple of days later...Should I have purchased and waited? How can I be sure that I would get it? Any info would be great.

I never had to wait for handguns or long guns, but I haven't stolen anyones property either.

There is no "waiting period" in Texas.  What happened is that the NICS check came back "Delayed" which means that they are checking back with whatever LEO agency has information on you to make sure that you successfully completed your probation/deferred adjudication and are not considered a "convicted felon" under Texas law.  They have 3 business days to do this and get back to your FFL.



Look up the information on filing a VAF application and getting a UPIN.  It will stop this in the future.  Call: 1-877-FBI-NICS (324-6427) select option 6 to get an application mailed to you.

Get a UPIN from nics so it won't happen again.  A chl works great also.

Considering he has a history, and IF that has caused the delay im not sure a UPIN would help. I thought that was so people with no history didnt get confused with someone who does who has the same or similar name.

As for the CHL, he cant for at least another 2 years. 5 years must pass before one can apply.

Yea i will try to apply for a UPIN...CHL is in the works but I will have to wait a couple of years...

As far as history and im assuming you mean criminal history, thats about as bad as it gets...no other arrests or priors....and yea i think I have to wait another 2yrs to get my CHL...

You are right, one of the purposes of a UPIN is to distinguish you from someone else with a similar name who has a criminal record (that is why I have one).





The other half of that is for those who really have criminal records that DO NOT exclude them from firearm ownership.





The way that NICS works is that it takes all of your information and then processes it against known lists of criminals and crazies.  If ANYTHING pops up, they have to investigate, pull records from the county or city court where any offense occurred and then check the final status of the case.  By law, all of this information HAS TO BE DELETED within 24 hours of a final processing decision.





What has happened to the OP is that the NICS check sees that he has had a felony charge pending against him.  The FBI then will contact the court where this charge was handled.  The court clerk (or whoever) will tell them that it was lowered to a misdemeanor and that he is legal to own firearms.  The NICS will then put that info into their computers and it will kick back a "proceed" they will then call the OP's FFL and give them the clearance to proceed.  24 hours later, all of this info will be deleted (by law) and each and every time the OP goes to buy a gun the same thing will happen.  





Again, this occurs because the FBI already has all of his information, and has his criminal information that makes the NICS computers yell "FELON, FELON!!!! WE HAVE A DAMN FELON HERE!!!!!"





All that the VAF will do is allow the FBI NICS folks to store one single additional piece of information about you (on top of the tons that they already have) that tells them that your case was dismissed, dropped, lowered to a misdemeanor... whatever,  and to keep that in the same file with all of your criminal information so that you do not get delayed every single time.  It is not a "registry" it does not allow the FBI or ATF to come inspect your home or anything... it simply removes the legal requirement to delete that "good" information about your criminal history after 24 hours.

If ti makes you feel better, you are eligible for a Utah CCW license right now.  It allows you to carry in Texas the same as a Texas license.  It will not help buying guns though.
