There's a small discussion on a truck forum I frequent about possessing a handgun in the state of Texas. What I believe to be true but would like to make sure of is:
-You only have to be 21 to purchase a handgun or handgun ammo from an FFL. -You can purchase a handgun through a face to face transfer at younger ages. -You don't need a CHL to carry in your vehicle in Texas as long as the weapon is out of sight and you are "traveling". However, I don't know if there are any other restrictions. Do you have to be 18 to buy a handgun through a FTF transfer? Do you have to be 18 to carry a handgun in your vehicle? Here's the link. I always thought there was a clause about traveling, but traveling was never defined, which made the clause useless. Read Penal Code 46.02 in my stickey above. It explains how a person who meets 4 criteria can carry a handgun in a vehicle without a CHL. They took the entire "traveling" issue out. I also have a section that covers penal code 46.15(b), which is where traveling is listed. You are correct, traveling is not defined. However, there are other methods of travel besides by car. |

One is fMaking a Firearm Accessable to a Child, and basically makes it an offense if a child gains access to a readily dischargeable firearm and the person with criminal negligence: (1) failed to secure the firearm; or (2) left the firearm in a place to which the person knew or should have known the child would gain access. Exceptions are made for being under adult supervision, etc. The second age related law is transferring a firearm to a person under 18, makes it an offense to transfer to a person under 18, with exceptions. |

Show him 46.02 of the penal code Google Texas Legislature, open the site, click on Statutes, click on Statutes again, scroll down to Penal Code and click on that, open 46.02. You can link it and copy and paste for him. I went and looked at your forum. I bet that guy had his last class prior to 2007, and THEN the law was as he writes. |
