You do the paperwork first. When it comes back, build what you want. Pretty simple.

Look around here-http://www.ar15.com/forums/forum.html?b=6&f=17

You should be able to find what you need to know. Good luck, I  plan on building my first SBR sometime early next year.

Buy a lower, build it out (don't use a short barrel for the test) and make sure it works and does not have any defects.      Once you are sure the lower is fine, then complete your form and mail off to the BATF.

You might want to consider going with a trust instead of the CLEO signature for your forms.  Not only do you not have to provide passport photos, you don't have the down time of having the FBI check your fingerprints everytime.  And only you and the ATF know you have them.

If AR, you could build Pistol (no buttstock) and then install after paperwork is back.  Be careful about constructive intent issues.  There is great information on the AR forum mentioned.

An AR lower has to be designated as a Pistol from the factory, I believe, in order to do this, can never have had a stock attached, etc etc etc.  The NFA geeks will know for sure on this.

Definitely, the OP should check out the NFA section under the armory.

Go to www.titleii.com and check out the " FORM 1 ". Print a copy and review it.  Next step is to find out if your city, county chief of police will sign off on it. If they will not, look at the trust/LLC route.  Never do a trust/LLC without first finding out if you can get a signature. If you go trust/LLC route, you don't own the item, the trust/LLC does.  This will cost several hundred dollars to set up.

Once you know what method you are going to go with CLEO signature, decide on barrel length of the UPPER you want, fill out the form. Over-all-length (OAL) is with the stock extended.  Ask someone to measure their length upper to get it's measurement in total with the flash hider removed, then measure the rest of your lower with stock extended, and this will be your OAL.  It does not need to be exact, down to the half-inch.

You'll have to get fingerprinted, fill out the citizenship form, cut a check for the fee to BATFE and mail your packet. It's easy.  Then you wait 90-100 days for approval.

The ARMORY section here and NFA sections are your friend.

Buy virgin receiver, have dealer transer as PISTOL, and you are good to go on the build.
