A friend of mine has a couple of these (for an AR) and is thinking about selling one. Can I buy this from an individual and it be legal? I know nothing about suppressors, so please school me.

As long as you can buy a handgun at a dealership, you should be fine. It takes a little longer than you'd think but its actually pretty easy. You will be doing what is known as a form 4 transfer. Over the price of the can, you will need to drop $200 to the fed's. You will also need a law enforcement signiture to complete the paperwork, but that varies by location (some good some bad). Since your budy has a couple, he should know the proceedure pretty well, it's not rocket science.

Yes, it's just like a face to face sale of a firearm, however you have to wait for the transfer to be approved by BATFE before you take possession.



Essentially, you work out a financial deal with your friend.

You BOTH fill out, in duplicate, the form 4.

You send in the form 4 with a check to the BATFE for $200 along with the certificate of compliance (citizenship form) and any other pertinent documents. Individual: will need CLEO signoff, FD-258 fingerprint cards with BATFE ORI number and passport photos.  Trust/corporation will need copies of incorporation documents and certificate of compliance.



Then you wait like everyone else until your friend gets the approved form 4 letter from the DOJ.



You still have to meet the requirements though. >18, not a felon etc. etc.

My buddy and I just sent our forms into the BATFE for the purchase of suppressors.  We were told turn around is from 4 - 6 months

He is former DEA (retired) and had suppressors when he was employed.  Now wants to get one for his "personal collection."  We are waiting to see if his approval is faster than mine.

No problem with the local Sheriff.  We live in Montgomery County and Sheriff Tommy Gage is very supportive of lawful ownership of these and other class III items.  We took completed forms (pictures and all) in to the Sheriff's Office on a Friday and were called on Tuesday that the forms were ready to be picked up.

The ability to "buy a handgun at a dealership" is irrelevant; if the OP is at least 18 years of age, then s/he can purchase a suppressor from an individual (but not from an FFL holder).
