My 21 year old son got an open container citation. He also got a ticket for running a stop sign. Is this just a pay the fine or dose he has to go to court? How will this affect his insurance? It was HPD so will be in Houston municipal court. |
| Tell him go a plea innocent. My wife did so on a speeding ticket not long ago and beat it cause the cop didn't show up. She got another one shortly after beating the first one and was unlucky that time, but she got defered ajudication. Your son may not be that lucky since, IIRC, open cantainer tickets are $500 plus. Good luck to him. |
+1 Dealing with HPD issued citations, I have always plead 'not guilty' and the officer never shows up. Last time I was in court, one of the judges was ill, so they pushed 2 court rooms into one. Out of the 60 cases on the docket, only four officers appeared. And those 4 defendants were already in jail. Worse case scenario, if he pleads not guilty, and the officer does show up, and he is found guilty, he will still have to pay the fine. They don't tack on more just cause he lost. At least now, he'll have a 50/50 shot of no one appearing. |
When I received one in S. Padre the citation was $150 for open container and the judge said it would not go on our records. This may have had something to do with Spring Break and they were whisking us through the court like a fast food restaurant. Basically we had to come in the morning after we got busted. It was pretty weird but I don't believe it is a felony. |
