So I just found out that my neighbor's tree has fallen on our roof and may have damaged it. I have asked them several times to trim their tree because it brushed on my roof and we've already had to replace bits n pieces. So my question is, do I go to them and ask them to pay for any damages or do I call MY insurance? |
Call your insurance... they will approach your neighbor and his insurance... Also, it your duty/right to trim any part of the tree that hangs over your property but if the tree did no overhang beforehand, it is 100% his fault. |

we do trim parts where it touches the roof. But it overhangs so much that that parts where we are suppose trim is on their side of the yard. We've asked them on several occassions to do their part and they've told us they would. We have a 30sec freak storm and the tree has fallen onto our evehangs and may have damaged the roof. The roof was replaced 2yrs ago as well. |
| This is a very tricky subject. I believe that if the owner of the tree ( and yourself ) knew that the tree was dead and you had proof that the owner of the tree did nothing then the owner of the tree is responsible for the damage to your home. But if the tree was healthy and tree fell due to a storm ( ACT OF GOD ) the home owners Insurance provider takes responsibility of the damage. They ( Insurance Provider ) usually also add $500 to remove the tree vertically with your property line. |
