Curious if anyone can tell me if Ponder, Texas in Denton County is Class II friendly? We are building a house and going to be moving out there and curious if anyone here knows? |

Class 3 is generally a misnomer when referring to 'firearms' regulated under the National Firearms Act of 1934 (NFA). In this context, 'firearms' means MGs, Suppressors, SBRs, SBSs, AOWs, DDs, Rewats, etc. NFA firearms are more accurately referred to as Title II firearms, in reference to the title of the United States Code (USC) under which they are regulated. 'Class' refers to a type of Special Occupational Tax (SOT) paid annually in June/July by the holder of a federal firearms license (FFL), which is valid for 3 years. Class 2 denotes a licensed manufacturer of NFA firearms, whereas Class 3 denotes a licensed dealer in NFA firearms. To answer the actual question posed by the OP, yes, you could legally do business in Ponder/Denton County as a Class 2 manufacturer of Title II firearms. To become an FFL/SOT, you will have to meet with ATF compliance inspectors to go over requirements for zoning, running a business out of your home, actually operating a business, filing taxes, and so forth. |
