How difficult is it to get Class 3 signoff in Dallas county? Easy, Difficult or Impossible

I know I've heard some of y'all say that there are some counties around Dallas where the Sherriff won't sign.

Pretty hard unless you have a personal friend. Suggest you live one county west (Tarrant), or NE (Denton). No problem in these counties.

From what I've heard, getting a class 3 sign off in Dallas Co. is nearly impossible.

Don't know. But I was at a shoot a month back with the Deputy who actually handles the paperwork, and he said no problem getting signed if you are not a felon. I didn't pay a lot of attention since I do not live in Denton County, but maybe something has changed. I know when Dee Anderson took over in Tarrant, he decided to continue to sign.

No one said it was impossible. Collin County is not impossible either, just more difficult. People just think because the Chief and Sheriff won't sign, it is over. It is not.

Mesquite for now. I got an apartment 3.5 miles from where I'll be working. I figure if I don't like it I can get more familiar with the area and move later.

Yall are forgetting a simple thing here. The Sheriff isnt the only person who can sign off...It calls for the chief law enforcement officer in your area  ie. Sheriff, Police Chief, I think u can also go to a few others also.

Ok, so let me give you the scoop in Collin County.  Plano, Frisco, and McKinney PD will not sign...known fact.   I have personal experience with Frisco PD.

Also a known fact, the sherriff only signs for his very good buddies (doesn't even sign for his own employees).

That leaves the DA...good luck there, how about a judge?  Haven't explored the judge issue, but might be worth it.

I am trying the Constable route.  This is somewhat questionable, but they are peace officers by Texas Law.

It's just much less hassle for me to keep them in a Corp.  I don't have to worry about shit and much faster turn arounds...(averaging 4 weeks right now.).

Federal Judge and District Attorney are considered CLEO in this case as well. There is a guy that post on AssualtWeb that got a sign off from a Fed Judge.

mm38,

That is very odd they are not even taken calls.

If I recall correctly, I heard on the TV the other day there where some concerns about the new sheriff
being very "non visible".

I wonder what's going on?

Why aren't they compelled to sign it?  It is just a verification that you are not a criminal, not a permission slip to own NFA toys.  I think the forms should be made generic enough so that they have no idea why you need the verification signature.
Incorporate.

   Success!.....well, sort of.

A Ms. McCoy of the Dallas County Sheriff's office called me late this afternoon on my way home from work.

The Sheriff has a person, Mr. Linsey(or Lindsey..I was driving and on the cell phone) is in charge of the office that the Sheriff has handle such paperwork.

It is that office's policy not to sign either a Form 1 nor a Form 4.  I'm not sure if it is the Sheriff's policy, the policy of that office or Mr. Linsey, or the department policy....or someone up higher in the county has told then not to sign.  This is also the office that handles paperwork from the state for CHL.

I have had a hard time contacting the Sheriff or a secretary at the published phone number of the Sheriff.  My fax was sent to the office that handles such things.  So we know at this time the forms will not get signed off, whether this is actually the Sheriff's decision herself is not clear.

mm

Who wants to try the Dallas County DA's office?  I'll try Garland and Rowlett too.

I need to clarify something.  I did not send the fax directly to the office that handles it.  I sent the fax to the Sheriff's office, from there it was forwarded to the correct office.

www.ccfa.com/NFAOwnership_IFRAME.htm

according to this, one could sue using the cases of  Steele v. NFA Branch, 755 F.2d 1410 (11th Cir. 1985) and Westfall v. Miller, 77 F.3d 868 (5th Cir. 1996) as precedent to force issuance.

What I was thinking was having a case of ARFcom(TX posse) v. NFA Branch so that a number of people could get their approvals at one time.

It's less heartache and cheaper to either setup a corp or dual residency in another friendly county.  You can sue, but there is no guarantee that a judge can/will compel them to sign.  Plus, complainants must be Dallas County Residents.

I'm much more in favor of a law like TN passed...It requires officials to sign Form 1's/4's unless there is a compelling reason (neg background check).

Sent email to Rowlett and Garland this morning.   They hadn't replied yet, I don't expect to hear anything from them until next week at the earliest.  Both have relatively new chiefs, Bates became chief in Garland about a year ago after Wilson retired,  Walling is the interim chief for Rowlett.

"If you'll bring the forms by Chief Wallings(sic) office(Police Admin, 2nd Floor, 4401 Rowlett Rd) with a copy of your driver's license, Chief Walling will review and contact you back."

This is the response from Rowlett PD's Public Affairs Officer.

Heya Frisco,

I'm just calling/faxing/emailing all the Dallas County LE Departments that I can get a hold of.  I don't think there is a list of ones that do and don't.

Mesquite looks particularly difficult.  I can't even find an email address, the chief's name, or an administration number to contact them.

BTW, would someone be willing to contact Dallas PD Chief Kunkle?  IM me and I will give the contact info and the format that I am using to inquire about Class 3 items...I will also explain why I cannot contact him myself.

Sorry if it sounded short, but your crusade to determine who will sign might bring undue attention to those who wish to even further deny our rights.

A much better method would be to work with local C3 FFL's to find out who does and does not sign.

If it's an unknown, then a person should approach their chief/sherriff to find out with forms in hand...Blind calling/emailing/faxing sniffs of a reporter or someone else looking for a story or dirt on the public official...better to do in person with the facts and a scheduled meeting.

Just my experience.

Wrong.

It is verifying that NFA items are legal to own in your area/state.  It does function as a 'permission slip.'  It is stating that the local laws do not prohibit the items.
