So I recently got approved for my SBR. I have my tax stamp and built my rifle. Question is about MA law.
1) If im reading it correctly you need to register your firearm within 7 days of TRANSFER, but since I built it does'nt that mean it was not a transfer? Did the paperwork when I bought the stripped receiver but thats it. 2) Made the SBR under my trust so technically I dont own it, my trust does and I just control the trust and its contents. So (again my thinking) I can't register something I dont own. 3) If I were to register it, how would I do so since according to MA, a rifle has a barrel 16" or longer? mine is a 5" 9mm. If it OK linking to another forum, I posted the same thing over there and here's what I got. I ended up registering as a pistol with a 5' barrel after reading some other information but I cant seem to find it now. But I figure as long as its registered in some way then who really cares. I dont plan on becoming a criminal anytime soon. If its ever checked for any reason I can debate it at that point over the state no recognizing rifles under 16". |

I think you are correct. But they also do not recognize rifles with barrels under 16", so that is the dilemma. The form doesn't ask if it has a stock or any other features either.
At least for now I have a paper trail showing I filed something even though it may be wrong. Maybe I should call the records dept. and see what they want but that might not be the best idea. If they tell me to put it as a rifle or anything else I will re-submit the E-FA10 and request some sort of publication to post. |

Registering a new AR or AK pistol in MA will draw unwanted attention. Unless it was an AR pistol on or before 09/13/1994 it's illegal as an "assault weapon".
As for the rest of your question, I can't help you there. MA law is so vague and confusing in that area. I find it difficult to comprehend outright stupidity. |

UPDATE:
Out of curiosity I called the state firearms record bureau today and asked about registration. I explained that it was a SBR and was indeed a 9mm rifle with a 5" barrel. Her response was" i'll check and be right back", she got back on the phone and said "I was correct to register it as a pistol because the state does not recognize a rifle with a barrel under 16". |

From a registration aspect, which is all they would know at the Records Bureau, I guess registering it as a pistol is what they felt was correct. But obviously they are ignorant of all other aspects of MGL. Going back to my original point, you just registered a handgun which is illegal as a post ban "assault weapon", which the possession of is a 10 year felony in MA. |

Tomorrow I will call back or email requesting in writing their ruling on the subject. I'm not worried or concerned about what it's registered as because they told me what to do and it cn always be changed later. |
