My daughter's friends (while shopping) shoplifted by putting merchandise in her purse & car without her knowledge. They were detained at the store and arrested but not read their miranda rights and were later released without bail also, the only thing they signed was for the electronic fingerprints. We have already contacted an attorney and will see him soon, is there any other advise that any one can give me on what steps we should take? The total value of the alegedly stolen merchandise is $382.00.

I'll be the Di#k.  I don't know you or your daughter so this is based on experience as former store security (many years ago-so things may have changed).  Most young teens use the excuse "My friends did it without my knowlege" when there has been video showing otherwise, so I think she knew and was inviolved.  If you and she talk to the store manager, ask forgiveness and do something showing good faith, the manager may drop the charges against her.  The store I worked at would drop charges if the offender swept the parking lot a few times.  Chances are If this goes to court the prosecutior will give her the chance to plead guilty to a lesser charge so she will pay a higher fine but not have a shoplifting charge on her record.  In this economy a shoplifting charge can screw her out of a job.  
My advise: use this as a teaching experience for her.  If she was involved she needs to learn that this is not OK.  If she truely wasn't involved this can be a lesson about choosing friends and choosing who to trust.  I also reccomend talking to the manager before spending the money on a lawyer.

Sounds like good advice to me. Over $200 turns the offense into a 4th degree crime but it will be remanded down to municipal court by the prosecutors office anyway.  She should apologize to the store for her involvement.  If it is her first offense she may also be able to apply for pre trial intervention.  Talk to the attorney and store management.

Miranda rights do not automatically have to be read to the arrestee, they usually come into play when the person arrested is questioned while in custody, if your daughter and her friends were not questioned about the theft and only answered questions regarding thier names, address and such the Miranda Warning would be moot.  Locked up a lot of people on warrants and almost never advised them of thier rights because they weren't being questioned.

No my daughter did steal the stuff. she lefted her bag on the cart I told her thousand of times not do that. While she went to the other side they but the stuff in it. The so called friend texted her admitted it. We saved the text.

100% true, but this should be kept out of court. You lawyer can certainly use the text messages in negotiations with the persecutor.



Not my business, but it sounds like your daughter needs some new friends.

I am having deja-vu over my niece. She was an A/B student on her way to college. She got pinched a time or two for shoplifting with friends in highschool. Nobody stepped in because it was supposedly just for excitement. One thing led to another... she ended up spending her 21st birthday in prison after a shoplifting escalated into a robbery.



I recommend that you step in and end those friendships.

Bad friends can wreck the lives of good kids.  A day does not go by that my brother-in-law not kick himself for not stepping in and ending those friendships when the first signs of trouble showed.

The sad part is my daughter signed a lease. her friends live with her. But the goods news is the apartment she is renting is from me. She already moved out. She is 2o years old. She broke her lease and now I have to figure out  how to remove her roommates from the apartment. She knew these girl since grammer school. My daughter was in  girl scouts and donates her time. volley for the town EMS system. My daughter always pick good friends and when one messes up she breaks the friendship. Some of her old friends quit school and have kids. or on drugs we live in a good town. most of the high school kids go to collage out of 350 330 went to collage.

Sounds like a good kid; you should be proud. All kids do stuff that is just stupid and is really not a reflection on who they are as persons.



Did these friends co-sign the lease, or did they sign any sort of agreement with your daughter? If not, the way you describe the situation above, you should be able to throw them out with reasonable notice.

Friend of mine growing up got caught shoplifting, he got a lawyer and had to write a 2 page essay regarding why he was sorry.  I attended court for a ticket I got when I was 18 and a 24 year old college student was there without a lawyer for shoplifting at Caldor's ($24 worth of music Cd's)  Judge gave him 4 days in county jail & fine, student was crying like a little girl.  They took him away immediately.

I wouldn't recommend she apologize for ANYTHING until you speak to the lawyer and give him all of the details of the case and evidence you have.  Just because the retailer decides he no longer wants to peruse charges, doesn't mean the LE agency or prosecutor will automatically drop them.  I’d bet dollars to donuts that the arresting officer is the signed complainant, not the retailer or an employee of the retailer.  Aspecially in an indictable offense scenario like shoplifting over $200, the retailer will have very little influence on the outcome of the case.  It’s important that she tell the lawyer the absolute truth no matter what.  He can't defend her properly with self defensive, fabricated statements.  If she had ANYTHING to do with it, she needs to tell the lawyer.  There's most likely video evidence of the entire act, which is a helpful thing if your daughter is telling the truth.  


The Shoplifting statute (2C:20-11b) is very specific in that the actor must "PURPOSELY" perform certain actions in order to be guilty of the act.  In subsection "d" of the same statute, you'll find the presumptions of the act which deal with possession of evidence or proceeds.  If there's video evidence or text messages that prove or even elude to someone else placing the items in her purse without her knowledge it doesn't automatically forge her defense, but she may be able to speak to the prosecutor and testify as a witness for the prosecution which would usually equal a plea deal (to complicity or conspiracy depending on the grading of the offense) or even a not-guilty arrangement for her.  However it would most certainly require her to testify in court for the case of the prosecutor.  Like stated above, in most counties the county prosecutor won't touch a 4th degree shop-lifting with no accompanying charges or a first time offender.  In Camden County even 3rd degree charges are kicked back to municipal court on first time offenses due to the overwhelmed superior court system.

Here in  my county, We sign the complaints and take a written statement as well as video evidence from Loss Prevention. 4th Degree Indictable Shoplifting <$500will be sent to the County and then kicked back to Municipal level.

The store LP will be issued a subpoena and things go from there.. Most times, 1st offense will get PTI. I hope she learns that these friends need to go. Also thew fact she rides Volly EMS cant hurt her case. WHile An atty is a good Idea, depending on where you are its not needed.

Ok..but how about the REST of it...the ones that YOU see in the Lockup are the ones that are either A: MULTIPLE Offenders, B: Committed another offense along with the shoplifting (Robbery/Resisting/Hindering), or had Drugs in possession, C" Shoplifted more than the $200 Indictable threshold, or D: Had outstanding warrants.  I've locked up hundreds over the years....Sucks when the nearby inner-city BUSSES it's criminals to shop/steal at your stores, and Unless there wa somthing other than just a DP Shoplifting they all walked out the door on a Summons complaint.

Only once in awhile for first timers, I have seen quite a few repeats. But the biggest aspect is that when  new one comes in.....it is all Hi...we missed you...remember jail is a subculture. They may be a first timer with a record. Now for first timers that don;t go to jail...they will be back

It's an indictable shop lifting, the OP said the amount was greater the $200 ($382 to be exact).  Even though it's only a 4th, it's still a "crime" and jail time isn't the worry here.  The worry that the OP and his daughter should have at the top of the priority list is this young woman's criminal history and avoiding an indictable offense being put on it. To the "bussed in" criminals that come in and out of our sub-urban towns to pillage, a criminal conviction means nothing to them therefor the consequences are minimal.  To good, upstanding and contributing members of society, the record could be far worse than the punishment.

Just because its downgraded or PTI'ed doesn't mean she won't have a criminal offense on her record.  I think your missing the point.  I can tell you this, if I had an indictable theft on my record when I was 21 years old, I wouldn't be doing what I do now....  If it was your daughter or you, would you take your chances with a prosecutor, judge or court system that you have no real knowledge of?  You would just take a chance and skip the very basic step of at least speaking to a lawyer?  And if this just happens to be the time that the AP decides to make an example out of someone, what then?  I work in Camden County bro, within a mile of the big shit pit of this state and capital of corruption.  Trust me, I've seen my fair share of kangaroo court, downgrades, deals and kick backs; but I've also seen plenty of cases that I thought for sure would get dropped like a brick but went on to full trial.  I'm not saying this girl is going to do a bid, I'm simply saying that taking this lightly just because its "only a 4th degree first offense" can absolutely come back to bight you in the ass in the future.  
I'm not trying to be argumentative about something so stupid that I have nothing to do with, but I really don't see why the advice given isn't sound.

Wasnt saying NOT to get an Atty..just not to treat it like the sky is falling.. A lot depends on the County as well.  Some counties will hammer eveyr little thing, as opposed to mine, where i have major indictables bounced down all the time.

I have heard several accounts of NJ persecutors "making examples" of middle-class kids.  They are irreverent to the fact that they are messing with the kid's life.
Life is challenging enough for young people today.  Get a lawyer.

Not trying to be an alarmist here... money invested in a RECOMMENDED attorney is worth the cost for your peace (piece of mind - because you will lose a piece if this goes bad). Think of it as a real investment in YOUR (mutual future.

Well we went to court and it was down graded below 200.00. Now it goes to municipal court. Next court date is Dec 28th. I did a get lawyer for my daughter the other girls do not have one. It was my daughter lawyer who was able to down grade the charge but since its was a group thing the other girls benifited from it. The girls are moving out of the apartment at the end of the month. I contected  a real estate agent to find me new tenats. Next update the 28th of Dec.

Ok, that's VERY good....about what i had expected (and hoped) you would tell us.  MOST likely (IANAL/YMMV) your Municipal Prosecutor will offer the plea dead with the PTI  (Pre-Trial Intervention) option.  She pleads guilty to the DP (Disorderly Persons) Shoplifting charge, pays restitution, doe a couple of months of probation, coupled with Community service (Since  IIRC you said she rides with local EMS, they can probably just roll it into that), and if she stays out of ANY further trouble then everything goes away after 6 months or so.  After a couple of years, she can go to court and get the entire record Expunged.

Good for you and your daughter.  I'm glad it worked out so far.  I would probably still try to get her a not guilty plea if the prosecutor will allow her to testify against the other girls, but that's up to your daughter and the lawyer to decide.  If a DP guilty plea and PTI is the worst that comes of this, you have to be relieved as there was certainly the potential for it to be much worse with a 4th degree charge lingering over her record.

Ignorance is no excuse for the law. If the polce are not going to ask questions to  your daughter during their investigation no miranda right are needed or required by the police. I guess get a good lawyer who knows the prosecutor and the judge in the area and this is a good lesson for your daughter to learn, NEVER talk to the police. Let then arrest her and figure it out in the courts. To many people think the police are going to let them go. HA HA HA. That is there job. to catch stupid teenagers. Do you really think a security guard or a police patrolman get much opportunity to bring down the kingpin of the Mexican drug cartels. Once again nevvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvver talk to the police and nevvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvvver sign anything. I just hope this doesn't ruin her life. Certain convictions pruclude getting sensitive secret clearences and professional certs. Get an expense lawyer and hope you can get it knocked down to a town ordinance or charges dropped from the store. By the way this is not legal advice in any way and should not be contruded as such. Actually, ignorance is an affirmative defense in NJ.  It needs to be reasonably applied, but you can ask for leniency base on ignorance.

Seems to me a patrol persons job is it ride around and harass and inforce laws that they can abuse to try to get around peoples rights. Trepass, speeding etc. They don't even investigate burglary rape murder etc. That is passed on to more exp. people.
So really what is left for the lowly patrol

My daughter and son  know very well never to speak with  authority with out legal counsel present since the day they wrer born .Next court is unknown for now.She does have a lawer. The other girls did not havea lawer  at that mome

What happen to my post. It is missing half of my post and my spell check did not work. Can some one explains why this happened. I will say this about our courts system it is a joke. While we were at the first court date. They had people going to jail like ( charged) ten times for the same thing. One young pretty girl was charge with attempted murder while steal $50.00 worth of gas. She was crying at the bail hearing $250,000 cash bail only. $ 50.00 worth of gas and her life is over. I was  amazed what people do in life to go to jail. This one person was in jail and charge selling drugs and bail was set at $500.00 with 10% cash option what ever that means. I am stupid or just lost in this world. I really do not understand all of this. This is a wake up call for me. I never want to go through this shit again.

This State is nuts.  I hear stories a couple times per year where some kid commits a petty or DP offense that escalates into life-changing criminal charges.  
My bet, the attendant probably tried to stop her from driving away by getting in front of her car.  Stupid.

This....as soon as ANY force is used, it's automatically an indictable Offense (ie. Felony)  happens a lot with Shoplifters, although it's almost always downgraded.
