Has anyone fought and won fighting a careless driving ticket. I would be happy having it reduced to unsafe driving. That has no points.

Most prosecutors will downgrade it to obstruction. saving you about 400 dollars. What jurisdiction?

I think you can only get like 3 unsafe drivings before the penalties outweigh the benefits IIRC.



The unsafe is good for paying off the courts to get rid of the points since the fine is high. You WILL have a hard time getting a prosecutor to reduce the charge to something besides unsafe because he is after the dollars.













I got a racing on highway ticket once and I got it reduced to obstructing passage of other vehicles, but it cost me $500 in lawyer fees, avoided 8 5pts on my license. Careless driving is only a 2pt ticket, you might just be better off paying the ticket and taking the pts if you have a clean record.

This is true too, your insurance can not penalize you for the first 2 point ticket. If you stay clean for a year 3 points come off, or you could take a DMV approved drivers safety class and take the two points off right away. My prosecutor will plea careless to obstruction or unsafe depending on the factual basis of the careless summons.

Thanks for the advise everyone. The ticket is only $85. My record was clean so I think I'll just pay it.

Not that it matters to many here, but I think you're doing the right thing... If you committed the offense that is...

The question is...Did you do it?

If you deserve it then I say pay it.  If it's way out of line and you don't deserve it then fight.

It's still $85 either way.

I beat a careless last year.  I was hit by a driver trying to pass me on the right at a single lane intersection.

  Cop issued both of us careless tickets with an accident report that was totally made up. Not even the street names where right.
The officer wouldn't talk to me but this officers supervisor was very interested.  Especially since he signed the report.
Got the ticket thrown out but it took some effort and I was willing to be found guilty by the judge.
