Hey there,
I have a friend who I've taken to the range a few times. He doesn't own any guns yet but is really into airsoft. Anyway, he somehow had 4 hollowpoint rounds end up in his bag. While participating in Air Force ROTC at our university, one of his fellow cadets saw the cartridges. Being a true warrior at heart, the cadet freaked out and squealed to his commanding officers or whatever they have in ROTC. This group of military men and women, being the hard-charging gunfighters they are, kicked him out of ROTC and called the police, who arrested him. Now he's suspended from school, out of ROTC, and has to go to court on Monday to face charges. Over 4 loose rounds.

So much for the myth that HP possession was only an add-on charge to be used when charged with other crimes. I've long said that the statute stands on it's own... unfortunately, now we have proof.
I'm sure the prosecutor will be more than understanding... and considering it's most likely your friend's first offense, he'll be offered a deal: plead guilty to the charge (2C:39-3f(1)), and get off with a few months probation, or perhaps just some community service. Oh, of course, by pleading to said 4th degree crime, which could be punishable by up to 18 months, your friend will be signing his 2A rights away, at least for the next 10 years - after which he can apply for expungement. Probably his only shot is to take it to trial, and with a decent attorney, convince the jury that he didn't KNOW that the HP rounds were in there - as the statute requires that one KNOWINGLY possess said HPs. Of course, there's always the chance that his attorney could convince the prosecutor of that, and that in the interests of justice, the case should be dismissed.... wouldn't count on that, though. It depends on how the prosecutor feels about guns in general. Most of them aren't fans. All in all... this really sucks. |

so let me see if I've got this right. This guy was arrested for having hollow point ammunition in his range bag at the range? Even under the fucked up NJ law, that should be perfectly ok. What am I missing here? If that's what happened, this guy is in a great position to win a few lawsuits. I do remember asking one of my friends who is a cop about this very thing, and being told that it's a secondary offense that you would never get charged with anyway unless you were already committing another crime.
