I'm just glad Mr Holmes was able to retrieve his airgun from where it was securely stored since the 10th of this month in time to tackle the intruder, and put two shots into him.
If he had used a more capable firearm the same principle of self defence under S.3 Criminal Law Act, Common Law and even ECHR still stands..........but might have been a bit more messy.. |

Quoted:
"Patterson was given 18 months in a young offenders’ institution after admitting burglary at Hull Crown Court " As he was 20, why didn't he get sent to a proper prison instead of a young offenders institute? I'm genuinely interested, not taking the piss. ![]() 'cos he has a mental age of 5 innit

Interesing bit of case law that said even if you used an illegally held firearm for self defence, you could be acquitted. You'd face seperate charges for possessing the firearm though. Could never remember where I found that case now. Some interesting and surprisingly sensible comments made by the judge. Just to clarify, I mention it because I found it interesting, not to suggest in any way, shape or form that someone should possess let alone use a firearm without appropriate authority. |

In this case it's probably because the adult jails are full ![]() |

Quoted: I'd love to post this in GD as a positive but I'd get slaughtered as it was an air rifle.... Well I hope you gents don't mind me giving you my .02 cents worth on this one (not sure what .02 cents are called on the other side of the pond). In any case, yeah to a degree it would be bashed to some length by most non thinking nuckledraggers in GD. Me, I have used a brain cell in the past, (one of few remaining) given how your firearm laws are over there. It does suck for the homeowner. To me though it would fall more under the heading of stupid criminal. PS. I still say you gents drive on the wrong side of the road ![]() I do know a few m8s from over there, seeing this now reminds me to drop them a line and say hello. |

Default doesn't always work. Besides since we drive on the right side we are in our right minds. Actually, from the historical perspective, we drive on the correct, i.e. the left side. When people routinely carried swords, it was usual to keep to the left of the road in case an oncoming traveller attacked you. If you are right handed and get into a sword fight, you try to keep your opponent to your right where you can better defend yourself and parry his attack. The Japanese know a thing or two about using swords and they follow the same convention. Why mainland Europe changed sides I don't know for sure, but I think it was to do with Napoleon putting his mark on the places he passed through. |
