Is it legal to swap out my A2 Upper for an A1 type, provided it is done by an RFD, a direct exchange & is not S/No'd to match the Lower ?

If it is brand new, then yes it is.
If it has ever been on a Sect 5 firearm, then the part is Sect 5, so no you can't
