Hey, I'm a former NM resident, current AZ and was back visiting family when I was snapped at one of the intersections for a speeding violation. What's the scoop on these tickets? Has anyone here gotten one? The upside is that the weather was really nice when I was there. |

Hello,
I too have received one of these speeding tickets. Was your ticket from the speed van or from an intersection camera? It doesnt really matter, they both work the same way. These are civil tickets and complete b.s. Because a police officer did not issue you the ticket it is not a criminal offense, it is civil. I will find out what can happen to you if you dont pay it. Since you are not a resident of NM you can blow it off and maybe have a non-extraditable warrant put out for your arrest here in NM. Or you can go contest the ticket and get community service for your lead foot. Or you could just pay it and be done with it. I just paid the darn $80 civil ticket to be done with it (I am also very close to the LE community here and could not escape it). |

I just checked, they can not issue a warrant for the ticket because it is civil. It just an administrative fee. Wont even come up if they run you through NCIC or MVD. If I were from outta state, I wouldnt worry about it. Jesster Can you provide documentation on this? Thanks! |

Jesster +1 the fees will keep adding up and at a certain point thay will start doubling. if you don't pay civil fee. it's not any different then if you did not pay your credit card. the city will at a point turn you over to a collection agency. who will start hounding you for the money and it will hurt your credit score. there is no legal way thay can issue a warrant for your arrest. most people from out of state that get caught by this unconstitutional scam don't even get the ticket as thay don't know where to send it to. i.e.: thay don't have other states dmv records on file. guess thay do share info with az. |

Just a theory of mine as I have not had to try it out yet but don't you have a Constitutional right to face your accusor? Can't you just ask the judge to honor this "Constitutional" right? Call me naive but it's my theory........ They attempt to get around this issue by making the photo ticket a civil fine and not a criminal charge. Your "right", as they define it, is to face your accuser in a criminal proceeding. As there is no criminal proceeding against you, they argue you do not have a constitutional right to confront your accuser. |
