I've been looking on this site for a while & finally decided to sign up. I'm curious to know the process of getting a short barrel registered for my AR. |

I am an FFL/SOT in Las Cruces with a handful of SBR's I made myself so here is the low down.. First off its not registering a short barrel for your AR, its registering your AR for a short barrel. There is a difference. First thing you have to have is the AR receiver. Next you download or order a Form1 from the ATF(I have a mess of them if you want some, along with all the other required forms). You fill it out accordingly(pretty straight forward) with all the information it requires(I can help you with this if you want). You tell them what length barrel you want to have on it etc..... Then you take the completed forms to your CLEO, usually your Sheriffs, State Police Commander etc.. Has to be a CLEO...Chief Law Enforcement Officer. It goes there for a initial signoff, they are merely certifying that they do not know that there is anything in their records that would prevent you from owning a SBR, Suppressor, Machine-Gun etc, this part of the process usually takes between 2 and 30 days(depending on who your CLEO is).... Once they return it with their signature on it you write a check to the Department of the Treasury for $200 and mail it to the address in the upper right corner of the front page. Now WAIT. My last form(before I became a Class3 dealer) took 22 days from the day they signed for the packet to when it was approved. That is FAST for the ATF/NFA. My first transfer was my .22lr suppressor and it took almost 5 months to get approved(couple years ago). Once they send you the approved form then you can attach the short barrel upper to the receiver. IT IS NOT SUGGESTED TO HAVE THE "PROCESS OF BEING REGISTERED" RECEIVER AND THE SHORT BARREL UPPER ANYWHERE REMOTELY NEAR EACH OTHER UNTIL YOU HAVE YOUR APPROVED FORM. ATF could consider it constructive intent and that is a felony without the right approved forms. Easiest thing to do is give the upper to your girlfriend, parents, neighbor you trust, coworker, Class3 dealer etc... until its approved. Yeah that probably being over cautious but better safe than sorry as "Its in the process of being approved" will not keep you out of jail should something happen that gets the police involved. I stress this because I used to work with an individual that was in the process of registering it and his wife called the cops for domestic/verbal abuse and when they asked if he was armed she said he has guns. They confiscated his guns and saw the receiver with no upper and the SBR upper in the other closet. He was charged with having an illegal weapon and was held without bail. Long story short it got cleared up, he got his form approved and loves his SBR. But it does happen, better safe than sorry. Last but not least you will need to engrave your name, city and state on the receiver as you are the manufacturer of the SBR. That is the process in a nutshell. I have some information for an excellent person that can swap out your HK94 barrel. When you get to that point let me know and I will dig that information out for you. They can engrave it however it has to be your info engraved on it as YOU are the manufacturer of the SBR, they merely performed a basic gunsmithing service. Most places that can swap out HK parts can do the engraving as well. If you have anymore questions please feel free to ask. -TS |

That works as well. Personally I would not take a chance on a trophy shop, what if they screw up? Are they going to replace your registered receiver? Nope they won't. I would send it to one of the engravers that engraves guns for a living. If you mess up a trophy then you try again on a new trophy, if you mess up an SBR you have a crappy looking gun! I wouldn't trust a SBR, or soon to be SBR with anyone that wasn't in the firearms industry. They don't get a good name unless they are good. Jason at Investment Grade Firearms can do all the work necessary for a proper SBR(chopping, threading, 3-lugging, and engraving). Reasonable pricing as well. If you want your future NFA (or any other type) transactions to go through quickly, I suggest getting a Class 3 C&R license. It establishes your 'credentials' with the ATF. It's only 30 bills for 3 years, and the benefits are worth their weight in gold. Since I became a C&R collector, I've noticed that transaction time is down to immediate, opposed to waiting 5 minutes. The savings from companies like Brownells, Midway, AIM, SOG, are great. Not to mention, guns shipped to your house And, once you have your license, if sombody steals one of your 'toys', they are charged with stealing from a dealer. I guess that means 'hard time' for them. You still have to get the CLEO sign-off on any SBR/Suppressor/FA stuff, but once you are 'in the system', it is much faster. Hope this helps. |

There is no such thing as being a Class 3 C&R holder. There is a C&R but not Class3 C&R. For others that don't know, all a C&R allows you to buy is specific firearms on the ATF C&R list and receive them at your licensed premises. You can't receive any modern firearms at your licensed premises, you would still need to go through a FFL/SOT for those items. Having a C&R will speed up the NFA transfer(barely) as they can verify your C&R status and know that they don't have to look tooo far into you to get the warm and fuzzy. But I have also found out that having a SOT(Class 3 dealer)license doesn't speed much up, its still the ATF and they still dilly-dally with transfers. As a licensed SOT my quicker transfer from licensed dealer to licensed dealer is 26 DAYS! The true benefit is that certain wholesalers accept the C&R as a FFL type license and therefore give you a dealer discount on stuff, unfortunatelyh it won't give you a discount on Title1 or Title2 firearms. Definitely worth the 30$ for 3 years! Plus it helps show the ATF that there are tons of people that are supporting the past and future of the firearms world. | Heads up for those that need the fingerprint cards in the Las Cruces area. The FBI office and The Sheriff's Dept. does not have them on hand. But you can get them at the Las Cruces Public School Administrative Offices (next to Graham's) for three bucks a set. Jackpot! |
Okay, I think you were reading too far into what I posted. First off, why is it an 03 license, but not Class 3? Aren't Curio and Relics class 3 weapons, ie, no longer produced, and basically relics? I'm not the hippest on the definitions. I obtained my 03 license on the behest of the gentleman who does, and has done all of my transactions for the past two decades. According to him, SBRs, suppressors and 'toys with happy switches' transfer quite a bit quicker when the Alphabet Boys already know you. Since I got my C&R, I've noticed that the time for whatever purchase I make has been shortened, and I'm not the sharpest tool in the shed. |

It is a "Type 03" FFL, which is a Curio and Relics FFL, not a Class 3 SOT. What I have is a "Type 01" FFL and am a Class 3 SOT(Class 2 SOT is a NFA Manufacturer). Meaning the Type 01 is a firearms dealer, the Class 3 is the Special Occupation Tax that is required for a Type 01 to deal in NFA items. Class 3 weapons are short barreled rifles/shotguns, silencers, machine-guns, AOW and Destructive Devices. Those fall under the NFA and Class3. Curio and Relics are generally out of manufacturer very old guns, and only ones on the ATF list qualify to be transferred as a C&R firearm. There are Class 3 C&R firearms however they still transfer the same as non C&R firearms. Class 3 and C&R firearms are totally different(with some exceptions of course) Having an Type 03 just declares to the government that you are a collector of NON-MODERN firearm that comply with their C&R list. It is a benefit that is extended by places like Midway that give you the same dealer discount I would get. My experience has shown that having a C&R will NOT speed up your process enough to make it worthwhile to speed up the process. You are still an individual, regardless that you are a licensed 03 C&R, you still need the background check and prints and to be run through the system. That doesn't waive you for anything along those lines, if so EVERYONE would be a C&R to get NFA and it would be worth the 10$ a year to speed that process up. Based on my experiences a C&R will get approved about 3-4 days before a non C&R holder. The alphabet boys knowing you helps so much it hurts. I have never received a immediate transfer since i got a clearance, mine are always delayed because their system says to look more into me as I have many fingerprint cards on file and they have to research why. In other words, I have tried to buy guns and I always have to come back another day to pick them up, the ABC's knowing you hurt you in the long run. Same experiences for other that I work with, they never get proceeds, always delayed. Hope this helps answer your question, if you have more please ask away and I will answer it best I can. -TS |

Dude, Tite_Shot is my shooting buddy. He knows what he's talking about. I've got a couple of Class Three items sitting in my safe and it's no more difficult than doing your taxes, using the EZ Form. Trust me, it's not that difficult. It's a matter of filling out your paperwork, getting your signatures, as necessary, paying your money and waiting your time. As for the fingerprint cards, you're gonna want to order them from the ATF (for free). The one's from the public library may not have the correct ORI code, which Tite Shot can tell you what it is, which tells the FBI where the cards goes & how it's processed. Happy shooting. |

Czexybeast is right, its super simple to fill out the paperwork(I'll even help you out on it!), and the rules/laws are very easy as well. Its a very simple process/thing to do. The correct ORI information thats needed on the fingerprint cards is: WVATF0800 ATF-NFA BRANCH MARTINSBURG, WV If it does not have this information on it then it will not be approved and will be rejected. The best place to get the print cards is online for free or from me as I have about 200 of these cards(being a Class3 dealer I get lots of these!) Or... blow the finger print all together!haveAnd all officers named on the application can have access to the class 3 item. It does not have to be under one person's control, as you do with an individual permit. This is the route I am taking, using my company's corporation paperwork. And yes, in NM, an LLC (limited liability CORP) is a corporation. And you have to file reports....hatJust waiting on the damn state to get me my paperwork!!!!!!! |
