Howdy, I have a friend who presentlyresides in Arkansas, she is now armed with a shotgun and a pistol because someone keeps trying to break into her house while she is home. I dont know if its dumb luck or if its intentional that she is always at home when it happens. She also has a 14 month old. Police department has already been out there and has no leads. So what I want to know is what are the legal requirements/precidents to use lethal force in Arkansas, I'm familiar with my own state's but I havent the faintest clue about Arkansas. So for the application of deadly force does he have to be inside? on the doorstep? prowling around the property? Castle doctrine? etc...any informaiton would be greatly appriciateed.

inside the house if she is in the house

Repeat the phrase:

"I was in fear for my life"

If she's outside the house, she can shoot within a reasonable distance (ie not 200yds) if she was "In fear of my life"

Pretty much what I thought it's about the same up here, I just feel bad all she's got is a .410 and some small caliber pistol. If she was closer I'd lend a hand... But I think she'll get him if he gets in. Thanks again.

If she intends to engage someone that's outside her home but on her property, she needs to be able to prove she was in imminent fear that person was about to commit a felony crime.  eg: they were going to set fire to her house.



If someone gains unlawful entry into her home while she is inside she can engage them without fear of prosecution.  Use the amount of force necessary to stop the threat.

If there was a report from the police about someone trying to break in, I'm sure that would be all the proof she needed for the "fear for her life."

Especially if the suspect hasn't been caught.

i believe so.  myself, if the target is ID'd as a legit threat, i'm sure as fawk pulling the trigger.

Somewhere within about 20 miles of Russellville, in a heavily welfare populated area. She stayed with her parents and let one of he good ol boy friends tend to the house so far he hasnt engaged. But she's going to be staying home now. She spoke with some neighbors who had some friends over and chased the guy back to his house. He lives directly behind her. Suspect information has been updated with the Police. I think this will hae been the 4th or 5th report total on the guy. Not sure if they're working on a felony warrant to snatch the guy and lock him up. I've told her what all of you have said and she checked with the judge she works for and he pretty much said, if you're afraid for your life pull the trigger. I informed her not to finish him off if the first barage doesnt and he's bleeding out on the livingroom floor, she agreed to stay within sight but out of reach and to leave the follow up shot to his actions ie he pulls a gun etc...

A .410 with slugs or buckshot inside a home is more than adequate if it is a semi.
