First off, I wanted to say that I have never once done these things thus far, so I have remained within the laws without taking any chances. I did want to ask some questions, however, to see just what I am allowed to do legally. I am a law-abiding citizen and have no intention of breaking any laws. I must admit, however, I am quite ignorant about what the laws allow for in some situations. So, here are my questions:



1. Can you keep a pistol in your car accessible from the driver's seat? Would you need a concealed carry permit in order to do so? If I encountered a law enforcement officer I would, as is expected, immediately inform them that I have a firearm for both my safety and their's.



2. A friend of mine said that open carry of pistols in a holster is allowed in Nebraska. Is this true? He also said that it is within the law to walk down the street carrying an uncased rifle. I found this hard to believe as I would be pretty nervous if I saw someone walking down the street with a slung AR-15. However, I did want to know if this was allowable by law.



3. Can you keep a firearm in your trunk on a semi-permanent basis with a loaded magazine accessible in the trunk as well? I have always kept my AR-15 cased with all magazines securely in the pouches on the case whenever I take it to the range or go anywhere with it. I was just wondering if there are any laws preventing me from having it in the trunk uncased? Again, if I encountered a law enforcement officer I would, as is expected, immediately inform them that I have a firearm for both my safety and their's.



I have searched for these answers on my own but I must admit I'm pretty awful at reading legal documents and was unable to locate laws pertaining directly to my questions. If there are any law enforcement individuals from Nebraska on this site, your insight would be invaluable. I apologize for any ignorance or stupidity expressed in this topic and appreciate your time and any information you can provide. Thank you.

1- Yes, I believe it needs to be unloaded though. No, you do not need a CCW to keep it out in the open.
2-Yes, open carry is allowed. You may get a talking to from a police officer because some libtard thinks youre a criminal carrying a gun and called the po po on you. There is a possibility of being charge with disturbing the peace.
3-I believe it needs to be in a case unloaded. I wouldnt want my Ar sliding around in a trunk though. Keep in inside the car with you unloaded. That is legal.

Someone else may chime in and help out.

As far as keeping an AR in your trunk, I was thinking about getting a rack of some kind back there. Although, if you can keep it in the main cabin of the car unloaded, that might work as well, although keeping it out of sight would be nice.

Loaded handguns and rifles in the passenger compartment are legal , but must be in plain sight, not under a seat or a jacket , but in obvious view. This applies to most of the state, except Omaha

Open carry is  legal in Omaha only if you have a Nebraska CHP or an Omaha Open Carry permit,  CHP's bypass Omaha's registration
other wise all concealable firearms must be registered to possess in Omaha

Loaded shotguns are not legal in an passenger vehicle, violates hunting regulations

You must also be aware that  on any school, college, university it is soon going to be a felony to possess a firearm on school grounds

I do live in Omaha. So in that case, I'm not allowed to do open carry without a concealed carry permit? How about the keeping a loaded (or unloaded) weapon in the cabin of my vehicle? What about in the trunk?

I don't actually own a pistol yet. I do intend to buy one within the next year (when I save up enough money). When I purchase it, I will be required to register it with the Omaha PD, yes.

NE is a pro-hunting state, not a pro-gun state.

If you are open carrying a pistol, expect to be hassled by law enforcement and possibly arrested for "Disturbing the Peace" or some other non-sense.  It is legal, but many cops don't know that law.

I don't think I would want to open carry in or around Omaha or Lincoln. I have during hunting season open carried just about everywhere I go. I have never once had a problem in over 10 years of open carrying. As already said you can carry a loaded rifle or pistol as long as it is in plain view.  Sorry but I don't know if it is legal or not to store a loaded firearm in your trunk. I like to have easy access to my ammunition and firearms but very seldom drive around with a loaded firearm that is being stored. I just feel its safer that way.

Or just stay out of Omaha.


I wish I could follow my own advice on that one, but I'm stuck here for the time being.
