| So I am going on a vacation and I wanted to buy a handgun but I dont have the HDP permit just the rifle permit I have not taken the handgun safety course. If I were to buy a handgun out of state and bring it back with me and register do I still have to have the HPD handgun permit and safety coures since I did not buy it in Hawaii? |

No. You just have to fill out the paperwork and register it. The asinine process we have is for a permit to acquire. If you bring a gun with you, you've already acquired it. Edit: If you are found to be unable to legally posses a handgun they will take it from you though. You have a longun permit, so that shouldn't be an issue. |
Thats what I thought just wanted to be sure. I hate that I have to spend $100 for the LIFE class then I have to go back and forth three times just to have a handgun. |

I am not sure where you are going, but some states won't even sell you handguns if you are not a resident that is living in the state, so I would call a gun shop near where you are going to check and see if the state has stupid rules like that. Once I tired to buy a gun in Arizona when I was living in California hey good luck! |

FIRST.........LOCAL LAWS VARY. By FEDERAL LAW........it's NOT a cash and carry deal for a Hawaii resident (non-FFL Dealer) making a handgun purchase in a foreign state from an FFL Dealer. You can buy it. But, for the actual transfer, you'll need to make arrangements with a Hawaii FFL Dealer to receive the handgun from the seller Dealer. And, as a (non-FFL) Hawaii resident you could make a cash and carry purchase of a rifle or shotgun in a foreign state from an FFL Dealer while on vacation. NOTE: I said, it could happen. But, most times, it's just too much of a problem for the selling FFL Dealer to know all of the Hawaii Gun Laws and to be sure that you have complied with all of them. So usually, the selling FFL Dealer will only make the actual transfer to another FFL Dealer in Hawaii. FROM THE ATF SITE. (B2) From whom may an unlicensed person acquire a firearm under the GCA? A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee's premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes. [18 U.S.C. 922(a)(3) and (5), 922(b)(3), 27 CFR 478.29 and 478.30] _____________________________ For a "private firearm transfer" (gift, inheritance or sale) between a non-FFL Hawaii resident (buyer) and a non-FFL resident of another state (seller)........the seller will need to transfer the firearm to an FFL Dealer in Hawaii. (B1) To whom may an unlicensed person transfer firearms under the GCA? A person may sell a firearm to an unlicensed resident of his State, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may loan or rent a firearm to a resident of any State for temporary use for lawful sporting purposes, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may sell or transfer a firearm to a licensee in any State. However, a firearm other than a curio or relic may not be transferred interstate to a licensed collector. [18 U.S.C. 922(a)(3) and (5), 922(d), 27 CFR 478.29 and 478.30] (B3) May an unlicensed person obtain a firearm from an out-of-State source if the person arranges to obtain the firearm through a licensed dealer in the purchaser’s own State? A person not licensed under the GCA and not prohibited from acquiring firearms may purchase a firearm from an out-of-State source and obtain the firearm if an arrangement is made with a licensed dealer in the purchaser's State of residence for the purchaser to obtain the firearm from the dealer. [18 U.S.C. 922(a)(3) and 922(b)(3)] __________________________ In all the cases involving your FFL Dealer in Hawaii, you can expect to be paying for the shipping to Hawaii and your FFL's fee. Once you get back to Hawaii, you pick up your firearm from the Hawaii FFL Dealer. The Hawaii FFL Dealer will be responsible to make sure that you comply with all of Hawaii's Laws and have filled out form #4473, before you take actual possession.
