Just fill me in.
If federal law says I can have NFA weapons but state law doesn't (Ie Iowa) wouldn't the supremacy clause trump Iowa law in this case? Just wondering as I learn more about gun related law. |

Quoted:
although i feel its wrong that iowa will not allow law abiding ciotizens NFA weapons i do feel very strongly that the state has more power that the fed. otherwise we are at hte mercy of DC and dont get to change anything. +1 on this. It should be the states job to regulate the states affairs. Hopefully in the near future as has been pointed out to me several times |

never explored it. good question though. i'd venture to say that since no other state has ever tried it and been successful in the matters of NFA weapons, you'd have a hard time fighting tom miller, the guy that is supposed to work on your behalf for this actually, to even read your brief...
i can assure you iowa will open up NFA weapons. the question is time, not if.... there is no more heavily regulated commodity in the US other than maybe plutonium, so it'll happen. |
| Supremacy clause will only work on the powers specified under the U.S. Constitution, all other powers as you know are reserved for the individual states. If you are talking about a transfer, yes Fed has authority. Individual ownership is still reserved to the states and was reaffirmed last year by the Supreme Court. |
