I just ran across this, so I figured others might not know about it either. Basically its a list of posted "NO CCW" businesses. www.mcrgo.org/mcrgo/d_no_gun_signs.asp |
If they don't fall under the categories of the law and you don't work there, it would have to be posted. |

I hope that the property owners realize that those signs carry no legal weight at all here in Michigan. Concealed means concealed. I don't worry about what signs they have posted. They can put them up to their hearts content. I go to 1 place listed on that list, and I rarely go there. They can do what they want, it's their property, they have the right to put a worthless piece of paper in the window that says "help yourself to whatever you want here, we are unarmed and proud of it".

I was there about a year ago, it's like a TJ maxx type of store. Don't worry you're not missing anything. The sales people were rude to boot. |
Thats what I was told in my CCW class last year too. If they were to see your gun printing or something they can kick you off their property, but they can kick you out for anything they don't like technically. I was told theres nothing they do to legally except have you leave. |
Thats correct, they can tell you to leave, which I would at that point. But as I said, those cute little signs they make and put up, don't amount to jack here in Michigan. I would love to hear someone robbing some place like that, getting caught, and then stating that they picked it cause they were dumb enough to put up signs that said no guns here!... I would laugh my ass off. I think a lot of these places are in the mindset that the police will come save them if something bad happens. Unfortunately, they don't realize that the police take the report AFTER the crime has already happened. The SCOTUS already ruled that the police have no duty to protect you, nor to get involved with anything happening. They can just sit in their car, eat a bagel, drink their coffee, whistle dixie, etc... I like to be responsible/accountable for my own person. I am not going to call the police, I am not going to be another victim on the statistics chart, and anyone who wants to think they are going to stop me from carrying because they put up a pretty little sign can get bent. |
Something that a lot of people are not aware of is that if you ever do have to use a concealed pistol in a posted/private property situation, under Michigan law, you are a trespasser with a gun. In lawyerese: +++++++++++++++ Q: My CPL has the box labeled "Exempt from Pistol Free zones MCL28.425o(4)" checked. How does this affect my carrying my firearm in an establishment which has a "No Firearms Allowed" posting? A: Even those who are exempt from the Pistol Free Zones established in the statute must still honor the wishes of any party in control of real estate regarding the possession of weapons on the premises. If you disregard a sign or a verbal or written notice that guns are not allowed in a particular location, your legal status is that of trespasser. One of the results is that you are no longer covered by the "Stand Your Ground" law that went into effect late last year. The Stand Your Ground rule allows individuals to use proportional force in self defense without having to retreat, so long as they are in a place where they have a legal right to be. Even a CPL holder who is exempt from the Pistol Free Zones loses this legal protection while carrying in violation of a posted notice that guns are not allowed on the premises. Source: CPL FAQ's/Ask the Lawyer +++++++++++++++ There's always the "judged by twelve, or carried by six" consideration, I suppose. |
Very interesting point that I had not considered. Thanks! |
